I thought it would be helpful if I set out my thoughts on the draft that you sent over this afternoon, in order that Xxxxxx, Xxxx and Xxx have something to look at to try which might assist them to agree what goes in and what does not go in the supplemental agreement.
SUBJECT TO CONTRACT. This agreement settles the legal, technical and commercial conditions of the injection, with- drawal and storage of the natural gas, which shall be delivered from CUSTOMER, in the “Storage RAG”. The “Specification Sheet of the Storage Services” (attachment ./1) contains the individual contract details and is an integrant part to this agreement. Furthermore the “General Terms and Conditions for Access to the Storage RAG” (GTCAS) and the attachment ./1 of the GTCAS (“Explanatory Note Operational Implementation”) are considered agreed by conclusion of this agreement. Both documents are as well integrant parts to this agreement.

SUBJECT TO CONTRACT. Associated Contestable Works Means all works of any kind to be provided and carried out by the Connection Provider as described in the relevant Site Specific Agreement excluding the Final Connection Contestable Works. Authority Means the Gas and Electricity Markets Authority as established by Section 1 of the Utilities Act 2000. CDM Regulations Means the Construction (Design and Management) Regulations 2007 and any amendment thereto. Charges Means the charges payable by the Customer to WPD as specified in any relevant Connection Offer including any variation made by WPD from time to time. Commencement Date Means the date of this Agreement.
SUBJECT TO CONTRACT. The Supplier acknowledges that BT is the data controller of the Data for the purposes of the Data Protection Legislation. The provisions relating to confidentiality in Condition [___________] of the Contract shall apply in relation to the Supplier's processing of the Data. In particular, the Data shall not without the prior written consent of BT, be disclosed or transferred to any person other than to [___________] or their personnel who have a valid reason for viewing or holding the Data. The Supplier undertakes to procure that all such personnel in [India] who will be viewing or who will have access to the Data in the course of providing services to BT will enter into a legally binding individual confidentiality declaration with the Supplier before commencing work in relation to the services. Prior to personnel being given access to Data, the Supplier will provide appropriate training to all personnel who will be dealing with or processing Data in relation to the relevant obligations under the Data Protection Legislation and security and confidentiality procedures including any security and confidentiality procedures reasonably requested by BT for the protection of Data and will provide refresher training when reasonably necessary.
SUBJECT TO CONTRACT. After overall consensus has been achieved on the underlying key commercial principles our legal advisor, Xx Xxxx Xxxxx of 0 Xxxxx Xxxxx, Xxxxxx, Xxxxxx (xxxx@xxxxxx.xxx) can prepare a draft joint venture agreement for circulation and amendment by e-mail. The following is our summary of what we consider to be the key commercial principles to be discussed and agreed between us for inclusion in the draft joint-venture agreement (‘JVA’). If there are other issues you wish to add, please include your comments in this draft and e-mail it to Mr Islam for consolidation into an overall working check-list of points to be re-issued for discussion and approval.
