Common use of Statutory Powers Clause in Contracts

Statutory Powers. This Agreement entered into by Deed is a planning obligation for the purposes of section 106 of the 1990 Act and is entered into pursuant also to section 111 of the Local Government Xxx 0000 and section 1 of the Xxxxxxxx Xxx 0000 and it is acknowledged by the parties that the obligations contained within it are binding on the Land and are enforceable by the Council as local planning authority and County Council as the highway authority against the Developer as owner of the Developer’s Land and against its successors in title and assigns in respect of its interests in each and every part of the Developer’s Land and against the Trust as the freehold owner of the Trust Land and against its successors in title and assigns in respect of its interests in each and every part of the Trust Land.
