Stage Payments Clause Samples
The Stage Payments clause defines a payment structure where payments are made in installments at predetermined milestones or stages of a project, rather than as a single lump sum. Typically, these stages might correspond to the completion of specific deliverables, phases of work, or achievement of certain objectives, with each payment released upon verification of progress. This approach helps ensure that the contractor or service provider is compensated as work progresses, while also protecting the client by tying payments to actual performance and deliverables, thereby managing cash flow and reducing the risk of non-performance.
Stage Payments. 12.1. Contracts that extend across several months may be subject to stage payments. Where applicable, these are defined in the Contract.
12.2. Carbon Footprint shall have the right to suspend all work on behalf of the Client where the Client has not completed the Stage Payments on time to the agreed schedule. Any adverse impact that this suspension has upon the completion of the Contract for the Client shall be at the Client's sole responsibility. This right applies not just to the Contract in arrears but also any other contracts with the Client, whether or not payments against these contracts are in arrears.
12.3. When it has been agreed that payment of all or part of the Contract is to be made 'in advance', Carbon Footprint will not commence work on the Contract until the agreed payment is received from the Client in its entirety.

Stage Payments. 13.1. Most contracts that extend across several months provide for stage payments. These are negotiated in advance as part of the normal discussions prior to agreement of the contract.
13.2. enlightenHR shall have the right to suspend all work on behalf of the client should these payments not be made on time to the agreed schedule. Any adverse impact that this suspension has upon the completion schedule or the quality of the product for the client shall be at the client's sole responsibility. This right applies not just to the contract in arrears but also any other contracts with the client, whether or not payments against these contracts are in arrears.
13.3. In particular, clients should note that where it has been agreed that payment of all or part of a contract is to be made 'in advance' work will not commence on the client's behalf until payment is actually received.
Stage Payments. 45.3.1. The Authority shall, subject to the following provisions of this condition, make to the contractor advances against the price(s) payable for Stage Payments (‘interim payments’) in accordance with Table 1 Stage Payment Schedule of this condition 45.3.
45.3.2. The contractor shall be entitled to interim payments, to be claimed in accordance with condition 35 for each stage under Table 1 Stage Payment Schedule of this condition 45.3, provided that:
a. the contractor has completed all work comprised in the stage for which the interim payment is sought in accordance with Table 1 Stage Payment Schedule of this condition 45.3;
b. all previous stages have been completed, unless the parties expressly agree otherwise; and
c. the contractor shall have complied with all its contractual obligations which enable the Authority to monitor the contractor’s contractual performance, including but not limited to those obligations related to the provision of information to the Authority.
45.3.3. Notwithstanding clause 45.3.2 above, the Authority shall not be obliged to make an interim payment to the contractor if it has reasonable cause to believe that the contractor will be unlikely to render complete performance of its obligations in respect of Table 1 Stage Payment Schedule of this condition 45.3.
45.3.4. Where the Authority intends to rely on clause 45.3.3 above as the basis for rejecting any claim for an interim payment which the contractor may make, the Authority shall give to the contractor notice in writing of its intention together with reasons and justification for the rejection.
45.3.5. The Authority shall without prejudice to any other right / remedy of either party be entitled to recover in full all interim payments made under the contract where:
a. the contract, or the part of the contract under which the Stage Payments at Table 1 Stage Payment Schedule of this condition 45.3 are to be provided, is terminated otherwise than in accordance with Condition 42, or expires by reason of passing of time; and
b. the contractor has failed to complete performance of the Stage Payments at Table 1 Stage Payment Schedule of this condition 45.3.
45.3.6. In the event of repayment to the Authority under the provisions of clause 45.3.5 above then all that, which vested in the Authority, under the provisions of DEFCON 649 (Vesting) and which related to the Stage Payments at Table 1 Stage Payment Schedule of this condition 45.3 shall re-vest in and become the absolute proper...
Stage Payments. All work carried out and undertaken by Better Visuals will be done so and provided with the opportunity for all Client/Associated Third Parties to either arrange payments in either 3 stage installments or in a final settlement at the end of the project. Without exception all final payments must be paid within the 30 day accounting period for all projects, whether provided in a single stage or over a 3 stage payment period. Upon final invoice all accounts must be settled within 30 days, from date of invoice. Where stage payments are agreed upon, and invoiced accordingly, each stage will be payable before the next stage commences.
Stage Payments. 2.6.1 Subject to the legal and any other requirements of this approval having been complied with in full, the Applicant may draw down the Advance in stages as set out in the Letter of Approval.
2.6.2 On completion of each stage a stage payment request or stage payment certificate will be required.
Stage Payments payment for a previously completed Work Stage. Until such payment has been received Prime Building Consultants Limited cannot commence with the next Work Stage.
