Soils Investigation Report. When a soils investigation report obtained from test holes at Site or for the Project is available, that report may be made available to Developer but shall not be a part of this Contract but shall not alleviate or excuse Developer’s obligation to perform its own investigation. Any information obtained from that report or any information given on Drawings as to subsurface soil condition or to elevations of existing grades or elevations of underlying rock is approximate only, is not guaranteed, does not form a part of this Contract, and Developer may not rely thereon. Developer acknowledges that it has made a visual examination of the Site and has made whatever tests Developer deems appropriate to determine underground condition of soil. Although any such report is not a part of this Contract, recommendations from the report may be included in the Drawings, Specifications, or other Contract Documents. It is Developer’s sole responsibility to thoroughly review all Contract Documents, Drawings, and Specifications.

DISTRICT does not assume any responsibility whatsoever with respect to the sufficiency or accuracy of any borings made, or of any logs of the test borings, or of other investigations, or of any soils reports furnished, or of the interpretations to be made from such information. There is no warranty or guarantee, either express or implied that the conditions indicated by such investigations, borings, logs, soil reports or other information are representative of those existing throughout the site of the Project, or any part thereof, or that unforeseen developments may not occur. At the DISTRICT's request, the CONTRACTOR shall make available to the DISTRICT the results of any Site investigation, test borings, analyses, studies or other tests conducted by or in the possession of the CONTRACTOR of any of its agents. CONTRACTOR is required to make a visual examination of the site and must make whatever tests it deems appropriate to determine the underground condition of the soil. XXXXXXXXXX agrees that it will make no claim against DISTRICT for damages in the event that, during progress of the Work, CONTRACTOR encounters subsurface or latent conditions at the site materially different from those shown on drawings or indicated in specifications, or for unknown conditions of an unusual nature which differ materially from those ordinarily encountered in work of the type provided for in the plans and specifications.

Geotechnical Information is provided to supplement the Contractors evaluation of the Site conditions within the Work area. The information is considered accurate at the locations indicated and at the time of the investigation. However, considerable variations in soil conditions may exist between test holes and fluctuations in groundwater levels can be expected seasonally. Bidders are responsible for any interpretation they place on the supplied information and may undertake additional soils investigations at the worksite as they feel necessary to satisfy themselves. Any test borings made by the Bidder shall be done in accordance with the requirements of the appropriate authority of the City of Winnipeg. Bidders shall notify the Contract Administrator prior to starting any soil boring operation.

Soils Investigation Report. When a soil investigation report obtained from test holes at the site is available, such report shall not be a part of this contract. Any information obtained from such report, or any information given on drawings as to subsurface soil condition or to elevations of existing grades or elevations of underlying rock, is approximate only, is not guaranteed, and does not form a part of the contract. Contractor is required to make a visual examination of site and must make whatever tests he deems appropriate to determine underground condition of soil. No claims for allowances or damages because of Contractor's negligence in acquainting himself or herself with the conditions of the site as described herein will be recognized.
Soils Investigation Report. Design-Builder acknowledges that it will make a further thorough visual examination of the Site. Design-Builder will review the Project and any available geotechnical report for any of the Sites. Except as provided in these Construction Provisions, no claims for allowances or damages because of Design-Builder’s failure to adequately acquaint itself with the known conditions of any of the Sites will be recognized. Design-Builder shall not be responsible for unforeseen soils conditions.
