Short Shipment. Purchaser shall notify Seller within 30 days of receipt of any short-shipment claim with respect to the Product and Seller shall use Commercially Reasonable Efforts to promptly address such claim to Purchaser’s reasonable satisfaction.

Short Shipment. If Knight determines that there is a shortage in the quantity of any shipment of Licensed Products (from quantities specified in the relevant bxxx of lading or other shipping documents), and it is determined that discrepancy existed at the time it was delivered to Knight from Synergy, Knight shall notify Synergy in writing as soon as reasonably possible, and Synergy shall make up the shortage within thirty (30) days of such notification at no additional cost to Knight.
Short Shipment. In the event sanofi-aventis ships a quantity of Product that is less than the quantity of Product ordered (except within the mutually-agreed acceptable variant of five (5%) percent of the quantity of Product ordered), CPP shall notify sanofi-aventis and sanofi-aventis shall forthwith ship the outstanding amount of Product. To the extent sanofi-aventis forthwith ships such outstanding amount, this shall be CPP’s sole and exclusive remedy for short shipment.

Packing, case size and weights shall take into consideration, where appropriate, the remoteness of the goods’ final destination and the absence of heavy handling facilities at all points in transit.

  • SHIPPING AND SHIPPING COSTS All delivered Equipment and Products must be properly packaged. Damaged Equipment and Products may be rejected. If the damage is not readily apparent at the time of delivery, Supplier must permit the Equipment and Products to be returned within a reasonable time at no cost to Sourcewell or its Participating Entities. Participating Entities reserve the right to inspect the Equipment and Products at a reasonable time after delivery where circumstances or conditions prevent effective inspection of the Equipment and Products at the time of delivery. In the event of the delivery of nonconforming Equipment and Products, the Participating Entity will notify the Supplier as soon as possible and the Supplier will replace nonconforming Equipment and Products with conforming Equipment and Products that are acceptable to the Participating Entity. Supplier must arrange for and pay for the return shipment on Equipment and Products that arrive in a defective or inoperable condition. Sourcewell may declare the Supplier in breach of this Contract if the Supplier intentionally delivers substandard or inferior Equipment or Products.
