Sexual harassment is a form of unlawful sex discrimination and is defined as deliberate, unsolicited verbal comments, or physical contacts of an intimate nature which are unwelcome sexual advancesto the recipient, requests or an expressed or implied threat to make decisions affecting an employee’s job or working conditions on the basis of an acceptance or refusal of a request for sexual favors, intimacy. Sexual harassment undermines the integrity of the employment relationship and other verbal or physical conduct of a sexual nature when 1) submission to such conduct is made either explicitly or implicitly a term or condition of an individual’s employment, 2) submission to or rejection of such conduct is used as the basis for employment decisions, or 3) such conduct has the purpose or effect of unreasonable interfering with an individual’s work or performance or creating an intimidating, hostile or offensive environmentwill not be condoned.
