SERVICING MOTOR CARRIERS. BROKER shall be solely responsible for selecting SERVICING MOTOR CARRIERS. BROKER shall ensure that all SERVICING MOTOR CARRIERS it utilizes for the transportation of cargo under this Agreement are fully authorized to perform services required hereunder in accordance with all applicable laws, rules and regulations. In no event will any SERVICING MOTOR CARRIER selected by BROKER have an unsatisfactory or unfit safety rating or otherwise be prohibited from performing, or unauthorized to perform, services for which it is hired by BROKER. BROKER will also ensure that the SERVICING MOTOR CARRIER has in effect at the time any cargo is tendered to such SERVICING MOTOR CARRIER that the SERVICING MOTOR CARRIER has in effect at the time of such tender the insurance coverages set forth in section 5, and that the SERVICING MOTOR CARRIER is in full compliance with the contractual requirements set forth in section 5. Likewise, BROKER is responsible to ensure that SERVICING MOTOR CARRIER performs all transportation services directly in Equipment operating under SERVICING MOTOR CARRIER’s authority, and that in no event will such SERVICING MOTOR CARRIER co-broker, subcontract, or otherwise tender cargo to be transported by any third party.

SERVICING MOTOR CARRIERS. Unless set forth in an Appendix, BROKER shall require by written contract that each Servicing Motor Carrier providing transportation services to SHIPPER agrees:
SERVICING MOTOR CARRIERS. BROKER’s sole responsibility with respect to selection and retention of Servicing Motor carriers is to make reasonable efforts to place CUSTOMER’s loads with responsible Servicing Motor Carriers: (i) authorized to perform the services required by CUSTOMER; (ii) which such carriers do not hold an “unsatisfactory” or unfit safety rating from the U.S. Department of Transportation; and (iii) that possess all insurance coverages required by applicable law. BROKER makes no express or implied warranties or guarantees concerning delivery time or the locating of a Servicing Motor Carrier to provide the transportation services requested by CUSTOMER.
SERVICING MOTOR CARRIERS. BROKER shall enter into a written contract with each Servicing Motor Carrier providing transportation services to SHIPPER and each written agreement shall contain the following provisions:

  • Trunk Servicing Orders between the Parties to establish, add, change or disconnect trunks shall be processed by use of an ASR, or another industry standard eventually adopted to replace the ASR for trunk ordering.

  • Specialized Vehicles Employees who must operate a motor vehicle on official State business and who, because of a physical disability, may operate only specially equipped or modified vehicles may claim from 34 up to 37 cents per mile, with certification. Supervisors who approve claims pursuant to this Subsection have the responsibility of determining the need for the use of such vehicles.

  • Receivables (a) Other than in the ordinary course of business consistent with its past practice, such Grantor will not (i) grant any extension of the time of payment of any Receivable, (ii) compromise or settle any Receivable for less than the full amount thereof, (iii) release, wholly or partially, any Person liable for the payment of any Receivable, (iv) allow any credit or discount whatsoever on any Receivable or (v) amend, supplement or modify any Receivable in any manner that could adversely affect the value thereof.
