SERVICES REMEDY. If Services do not comply with the Services Warranty or are in any manner found to be nonconforming during the Services Warranty Period, Contractor promptly shall remedy the non-conformance, or at Purchaser’s election, Contractor shall re-perform or correct the nonconforming Services at no additional cost to Purchaser or refund the amounts paid for the Services.
SERVICES REMEDY. With respect to the labor, if any Services warranted hereunder prove defective or non-conforming, VWR's sole liability and Customer's sole remedy hereunder will be for VWR, at VWR’s option to: (i) re-perform the Services, at no cost to Customer; or (ii) credit Customer's account for all amounts paid with respect to the defective or non-conforming Services. With respect to any parts provided by VWR in performing the Services, if any such parts prove defective or non-conforming during the first thirty (30) days after installation, VWR’s sole liability and Customer’s sole remedy hereunder will be for VWR, at VWR’s option, to:

VWR, at its option, may require Customer to return the part to VWR, F.O.B. origin, or may modify, repair, or supply a replacement part at the point of installation. VWR will accept no responsibility if such part has been improperly operated or maintained, or if Customer has permitted any unauthorized modifications, adjustments, and/or repairs to the part.
SERVICES REMEDY. If InfluxData’s performance of its obligations under the Support Program fails to conform to the warranty set forth in Section 6.1.3 above, then Customer’s exclusive remedy and InfluxData’s sole obligation will be as follows: (a) following notice of non-conformance, InfluxData will have 30 days in which to correct the non-conformance at no additional charge; and (b) if InfluxData has not corrected the non-conformance within such period, then InfluxData will refund Customer the fees paid to InfluxData for the non-conforming services.

If VisioLogix’s performance of its obligations under the Support Program fails to conform to the warranty set forth in Section 6.1.3 above, then Customer’s exclusive remedy and VisioLogix’s sole obligation will be as follows: (a) following notice of non-conformance, VisioLogix will have 30 days in which to correct the non-conformance at no additional charge; and (b) if VisioLogix has not corrected the non- conformance within such period, then VisioLogix will refund Customer the fees paid to VisioLogix for the non- conforming services.
SERVICES REMEDY. Subject to contrary provision in a Statement of Work, in the event any type of Services are provided which breach the Warranty of Section 3.1.6, 3.1.7 or 3.1.9, RIMS shall use commercially reasonable efforts to cure the breach during the Cure Period. Upon RIMS' failure to cure the breach or to use commercially reasonable efforts to cure within the Cure Period, Customer's sole remedy shall be to terminate the Statement of Work applicable to the Services not provided in compliance with this Warranty and/or damages as permitted in Section 4.3.1.
SERVICES REMEDY. If Verdiem’s performance of any of its obligations under the Support Program fails to conform to the warranty set forth in Section 6.1.3 above, then Customer's sole and exclusive remedy shall be as follows: (a) following notice of non-conformance, Verdiem shall have thirty (30) days in which to correct the non-conformance at no additional charge; (b) if Verdiem has not corrected the non-conformance within such period, then Verdiem shall refund Customer the fees paid to Verdiem for the non-conforming services.

If Brentmark’s performance of its obligations under the Support Program fails to conform to the warranty set forth in Section 6.1.3 above, then Customer’s exclusive remedy and Brentmark’s sole obligation will be as follows: (a) following notice of non-conformance, Brentmark will have 30 days in which to correct the non-conformance at no additional charge; and (b) if Brentmark has not corrected the nonconformance within such period, then Brentmark will refund Customer the fees paid to Brentmark for the nonconforming services.
