Common use of Servicers to Service Mortgage Loans Clause in Contracts

Servicers to Service Mortgage Loans. (a) For and on behalf of the Certificateholders, each Servicer shall service and administer the Mortgage Loans for which it is acting as Servicer in accordance with the terms of this Agreement and the respective Mortgage Loans (provided, however, that prior to the Servicing Transfer Date the NC Capital Mortgage Loans shall be serviced by New Century; and, provided further that from and after the Servicing Transfer Date, Countrywide Servicing or Wells Fargo, as the case may be, shall service the NC Capital Mortgage Xxxxx pursuant to this Agreement) and, to the extent consistent with such terms, in the same manner in which it services and administers similar mortgage loans for its own portfolio, giving due consideration to customary and usual standards of practice of mortgage lenders and loan servicers administering similar mortgage loans but without regard to:
