Common use of Service Plan Clause in Contracts

Service Plan. 2.1 Add-on data SIM or add-on data SIM (For USB modem) (“Multi-SIM 4G / 3G Plans Service”) is only applicable to Customer who subscribes to a designated “unlimited data usage up to 5GB” monthly service plan (“Specified Service Plan”), including a) $298 or above Device bundled Smartphone 4G / 3G Plans; or b) $398 or above iPhone Bundled 4G Price Plans 2.2 The Customer shall use the Service Plan for Multi-SIM 4G / 3G Plans specified in the Sales and Services Agreement during the Multi-SIM 4G / 3G Plans Term. The Customer may by return SMS purchase a top-up of 1GB at $100 (“Top Up”) for usage of data for the remaining period of that month. If the Customer does not wish to purchase the Top Up, local data service under the relevant Service Plan will be automatically suspended when the Customer’s data usage reaches the Specified Data Usage. Customer may purchase the Top Up at that time or wait until the beginning of the next monthly bill for the new Specified Data Usage allowance under the relevant Service Plan. 2.2.2 Where the Customer has registered more than one Service Plan in an Account, the Company will notify Customer's primary service number (i.e. the first registered service number) by SMS whenever a Top Up is confirmed. 2.3 Add-on data SIM provides data service only, excluding any voice service. 2.4 If the Customer service number under the Specified Service Plan is terminated/ disconnected for whatever reason, the add- on data SIM will be terminated automatically at the same time. 2.5 The Company does not guarantee the services under the Service Plan will be compatible with the Customer's HSPA devices.

If the Customer does not wish to purchase the Top Up, local data service under the relevant Service Plan will be automatically suspended when the Customer’s data usage reaches the Specified Data Usage. If the Customer does not wish to purchase the Top Up, local data service usage under the relevant Service Plan iPhone with 4G / 3G Plans will be automatically suspended when the Customer’s data usage reaches the Specified Data Usage. Customer may purchase the Top Up at that time or wait until the beginning of the next monthly bill for the new Specified Data Usage allowance under the relevant Service PlaniPhone with 4G / 3G Plans. This is only applicable to designated service plans (1GB or above) with an “Advise & Consent” mechanism for the purchase of top-up data. 2.2.2 2.4.2 Where the Customer has registered more than one Service Plan in an Account, the Company will notify Customer's primary service number (i.e. the first registered service number) by SMS whenever a Top Up is confirmed. 2.3 Add2.5 This Service Plan is charged on a monthly basis. The monthly charges for the first month will be charged on a pro-on rata basis from the service effective date to the first bill date. The monthly charges are payable in advance and non-refundable under whatever circumstances. 2.6 This Service Plan is not applicable to 2G phones / connected devices or any phones / connected devices which have manually opted for 2G network. 2.7 This Service Plan cannot be used in conjunction with FUP Unlimited Data Plan and Tag-On SIM Plan. 2.8 The Customer of this Service Plan can opt for an additional SIM card during the Term. The additional SIM card does not include any data usage, and its data usage will be counted towards the usage of the Specified Service Plan. The additional SIM provides data service only, excluding card does not provide any voice service. 2.4 . If the Customer service number under the Specified Service Plan is terminated/ disconnected terminated for whatever reason, the add- on additional data SIM will be terminated automatically at the same time. 2.5 The Company does not guarantee . Unless otherwise specified by the services under Customer, the service of the additional SIM will continue to be provided to the Customer after the expiry of the Term of the Specified Service Plan Plan, and such additional SIM service will be compatible with the Customer's HSPA devicesswitched to a then prevailing comparable plan on non-contract basis that is specified from time to time.
