Service Guarantee. 8.1. All pesticides used by Prokill are approved under the Control of Pesticides Regulations and have been assessed for any hazard under C.O.S.H.H. (Information on request). You are covered by our Unique Service Promise, which means if we do not deliver the minimum contracted annual visits, we {Ref: YCM/00251276-3} will refund 100% of that years’ Service Agreement subject to payment terms being met.
Service Guarantee. The Service provider will bear responsibility for any late payment related charges up to Fifty Dollars ($50.00) should a Payment post after the Scheduled Payment Due Date or Deliver By Date, provided that the Payment was scheduled and the Payee information was maintained in accordance with the guidelines described within this Agreement. Notwithstanding the foregoing, the Service provider shall not be responsible for any such charges if the Service provider does not have responsibility or liability for a Payment transaction, late payments or late payment related charges under the other provisions of this Agreement, including, without limitation, those payments described under the Exception Payments section below.
Service Guarantee. Due to circumstances beyond the control of the Credit Union, particularly delays in handling and posting payments by Payees or financial institutions, some transactions may take longer to be credited to your account. The Credit Union will bear responsibility for any late payment related charges up to $50.00 should a payment post after its Due Date as long as the payment was scheduled in accordance with the guidelines described under “Payment Scheduling” in this Agreement.
Service Guarantee. 89.1 The Provider must conduct the Program Services at or above the minimum standards in the Service Guarantee set out in Annexure C2.
Service Guarantee. Unless a late payment related charge is incurred for one of the reasons listed below, we will reimburse you for any late payment related charges, up to $50.00 per late payment, should a payment be delivered after its Actual Due Date, so long as the payment was scheduled in accordance with the guidelines described under "Scheduling Payments" above, and we have issued you a confirmation number for the payment. We may require that you provide us with satisfactory written documentation of any late fees before making reimbursement to you. We are not responsible for any failure to complete or delay in completing any payment due to any of the following:
Service Guarantee. 8.1 No representation or warranty - Videotron makes no express or implied representation or warranty regarding the Services and Equipment, other than its obligations under this agreement. The Services and Equipment are supplied “as is”, subject to availability.
Service Guarantee. If we do not properly complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for the amount of any losses or damages incurred by you and resulting directly from such failure up to $50.00. We will not be liable in the following instances:
Service Guarantee. Notwithstanding anything to the contrary contained in this Agreement, you may terminate this Agreement without any further obligation if the Services we provide are not substantially performing up to industry standards during the first ninety (90) days the Services are available for your use. If you elect to terminate the Agreement pursuant to this guarantee, we will reimburse you for all reasonable costs you incurred to re-establish service with another service provider not to exceed the amount that you paid to us for installation of the Services. This Service Guarantee only applies if: (a) the cause of the Service deficiency was within our reasonable control; (b) you ordered at least the amount of Services that we recommended to meet your traffic volumes; (c) you give us written notice of the deficiency within the first ninety (90) days after we notified you the Services are available for your use, and (d) we fail to correct the Service deficiency within fifteen (15) days after receiving written notice from you of the deficiency.
Service Guarantee. 6.1 The Supplier will use reasonable endeavours to put in place a repair to a Service Failure in line with the Service Level Agreement (“Service Guarantee”).
Service Guarantee. If the payment is received later than the delivery date specified at the time the payment was scheduled, the user is eligible for a refund of the convenience fee. However, late fees charged by the payee are not the responsibility of Northland Area Federal Credit Union and will not be refunded. All other conditions applicable to the Northland Area Federal Credit Union Bill Payment Service apply to Expedited Bill Payment transactions except for those situations where the Expedited Bill Payment terms and conditions are in conflict. In those situations, the Northland Area Federal Credit Union Expedited Bill Payment terms and conditions take precedence. Limitations: Expedited Electronic Payments are available for a limited number of payees. Availability of Expedited Payment options will be limited based on xxxxxx capabilities, time of day, payment delivery mechanisms and other factors. Expedited Payments will be unavailable for delivery to P.O. Box addresses or locations in AK, HI, or any foreign or U.S. territory outside of the contiguous 48 states and District of Columbia. The User is solely responsible for entering and verifying any address for overnight check payments to ensure it is correct and is specified as a valid overnight package address by the xxxxxx. Due to the inherent need to expedite the payment, payment instructions will be processed and completed immediately upon submission of a request from a User. The User will not have the ability to edit or cancel the payment instruction after he has confirmed the payment request. INDEMNIFICATION Subscriber shall indemnify, defend and hold harmless the Financial Institution and Service provider and their affiliates, officers, employees, directors, suppliers and agents, in their individual capacities or otherwise, from and against any Losses arising out of: (i) Subscriber's negligence; (ii) Subscriber’s failure to comply with applicable law; or (iii) Subscriber's failure to comply with the terms of this Agreement.
