Common use of Seniority Lost Clause in Contracts

Seniority Lost. Seniority shall be lost by a bargaining unit member upon termination for cause, resignation, retirement, or when recall rights are exhausted. Upon voluntary transfer to a non-bargaining unit position, bargaining unit seniority shall neither accrue nor be lost while the employee is in such a position. Should the member not return to the bargaining unit within thirty (30) working days of voluntary transfer, the member shall forfeit all bargaining unit seniority and will have no claim to return to the unit. Such seniority may not be used to re-enter the bargaining unit during a layoff, if it would result in the layoff of a currently employed bargaining unit member. However, the employee can use his/her accumulated seniority to apply for an open position and return to the bargaining unit, or accept a position in a non-bargaining unit position while on layoff from a bargaining unit position and shall continue to accrue seniority in the bargaining unit.
