Common use of Seniority Definition Clause in Contracts

Seniority Definition. Seniority shall be defined as the length of the employee's service within the bargaining unit, prorated for regular part time employees, during their current period of employment with the Employer, reduced for unpaid leaves of absence (excluding FMLA and approved time off) and layoffs of 30 days or longer. Employees who are employed on the same date in the bargaining unit shall be placed on the seniority list by date and time of application. For purposes of vacation and longevity, the length of service shall be determined by the employee's last date of hire with the Employer.

Classification Seniority shall mean the length of continuous service commencing from the date of the employee's service in his/her particular classification. Classification Seniority will be used for purposes of layoff, reduced for unpaid leaves of absence (excluding FMLA recall, shift selection, vacation requests, and approved time off) and layoffs of 30 days or longerover time, as defined in the contract. Employees who are employed on the same date in the bargaining unit shall be placed on the classification seniority list by date and time in alphabetical order of application. For purposes of vacation and longevity, the length of service shall be determined by the employee's last date of hire with the Employersurnames.

"Last hiring date" shall mean the date upon which an employee first reported for unpaid work at the direction of the Employer and since which he has not lost his seniority under Section 8.4. No time shall be deducted from an employee's seniority due to absences occasioned by authorized leaves of absence (excluding FMLA and approved time off) and layoffs of 30 days absence, vacations, sick or longer. Employees who are employed on the same date in the bargaining unit shall be placed on the seniority list by date and time of application. For purposes of vacation and longevityaccident leaves, the length of service shall be determined by the employee's last date of hire with the Employeror for layoffs, except as hereinafter provided.
