Seaworthiness. The District may require, on seven (7) days’ written notice, a demonstration of the Vessel's operability to the satisfaction of the Harbormaster or the Harbormaster’s designee. Licensee’s failure to prove operability of the Vessel to the satisfaction of the Harbormaster or the Harbormaster’s designee, shall be justification for the District to terminate this License upon 30 days’ written notice to Licensee.

Seaworthiness. Save for periods when the Ship is in dry-dock, the Lessee shall procure that the Ship should at all times be fit to go to sea without serious danger to human life (by reason of the condition, or the unsuitability for its purpose, of either the Ship or its machinery or equipment or any part of the Ship or its machinery or equipment or undermanning or overloading or unsafe or improper loading or any other matter relevant to the safety of the Ship).
Seaworthiness. Vessels must be (i) able to actively navigate seas or open waters, (ii) be maintained as to appearance, including, but not limited to, regular cleaning, maintenance and replacement of all painted and varnished surfaces, all bright- work, rigging, safety equipment and any other appurtenances, (iii) if equipped with an engine or motor, it must be operable and capable of producing sufficient way to make the Vessel maneuverable in accord with (i) above, (iv) if the Vessel is a sailboat without an engine, she must be equipped with sails, and her standing and running rigging must make her capable of producing sufficient way to make the Vessel maneuverable in accord with (i) above, and (v) at all times in compliance with the then applicable regulations, rules, orders, statutes and laws pertaining to water quality and safety. The Company may, at their own sole and absolute discretion require Vessel Owner to provide proof of compliance by current inspection from the U.S. Coast Guard. Houseboats are expressly deemed not Seaworthy.
Seaworthiness. With respect to any Vessel provided by Carrier pursuant to this Contract, Carrier shall be bound to exercise due diligence at all times during the entirety of the Contract term to:
Seaworthiness. Owners represent and warrant that at all times, during the term of this charter, they shall exercise due diligence to maintain the Vessel in a seaworthy and cargo worthy condition in all respects. Notwithstanding any other provisions of this charter, if, during the term of the charter, the Vessel is determined to be incapable of safely maintaining, caring for, or carrying Charterers’ cargo, then Charterers shall have the rights set out in clause 4 (c) and 17 herein.
Seaworthiness. Owner warrants that at the commencement of loading (i) each Provided Vessel will be seaworthy, properly manned, equipped and supplied for the voyage, (ii) the cargo tanks, pipelines, and valves of each Provided Vessel will be suitable for the Cargo, and (iii) the pumps and heating coils, if any, of each Provided Vessel will be in good working condition. Owner will, as far as these conditions can be obtained with the exercise of due diligence, further maintain such condition and will use best efforts in the loading, stowage, custody, care and delivery of the Cargo. Owner will provide sufficient towing power including assisting tugs to handle properly and safely any Provided Vessel(s) while both in loaded and light conditions. Owner will use best efforts to maintain the seaworthiness of all Provided Vessels throughout the voyage and Owner and the Provided Vessels will be in compliance with all local, state and federal laws, ordinances and regulations at all times.
Seaworthiness. Included in this agreement is an inspection checklist to assist the owner/agent in preparing the vessel for transit. Upon dockside arrival, the Captain will use the fore-mentioned checklist to inspect the vessel to determine its seaworthiness and to verify compliance with necessary Coast Guard requirements and CFR's for that particular vessel. If the Captain determines the vessel is not seaworthy or does not meet minimum CG requirements, he will state his reasons in writing on the checklist to the owner/agent. Accordingly, if the owner/agent fails to address the noted deficiencies in a timely manner, the crew will be paid for all days worked up to and including the day of termination, plus travel days, along with necessary airfare for crews return to domicile. VESSEL EQUIPMENT: Vessel shall carry all current registration, documentation and insurance papers and be equipped with docking lines of ample length and girth equal to the number of kevels installed, appropriate numbers of anchoring devices and fenders of adequate size for locking and mooring. Also expected on board will be multiple sets of fuel filters for the main engines and genset(s), along with at least four one gallon containers of oil normally used in the main engines and one gallon of oil for the genset(s). The vessel must also carry the necessary tools to maintain simple repairs and maintenance while underway, to include spare bulbs, belts, etc. Vessel shall also carry ample supply of bed linens, cooking utensils and cleaning supplies, including dish detergent, paper towels, etc., along with deck cleaning supplies and equipment to support the delivery, and as conditions allow, the crew will wash down the vessel to remove accumulated salt spray, diesel exhaust soot, or other harmful agents. Vessel shall also carry all charts, navigation instruments, binoculars, hand-held VHF radio, etc., as necessary to complete the trip over waterways specified above. Unless there is already a working cellular phone on board, the Captain shall also provide a cellular phone to conduct vessel business as described, with reimbursement provided for said calls upon completion of voyage.

Seaworthiness. Cruise Line represents and warrants that the Vessels shall at all times (except during a Withdrawal or a Force Majeure event) be in seaworthy condition, certificated to proceed at sea and carry passengers under the laws, regulations and specifications in effect from time to time of the country of each Vessel's flag, the country of embarkation and the countries of all ports of call.
Seaworthiness. The Vessel's hull, machinery, tackle, gear, apparatus, and equipment shall be seaworthy in all respects, and conform to the minimum standards set forth in the applicable Code or Federal Regulations for the Vessel's class.
