Scope of Prohibition. Except as provided in this Article II and the Partnership Agreement, Xxxxx GP and each HFC Group Member shall be free to engage in any business activity, including those that may be in direct competition with any HEP Group Member.

Except as otherwise provided in this Agreement and the Partnership Agreement, each CVR Entity and Each Partnership Entity shall be free to engage in any business activity whatsoever, including those that may be in direct competition with the CVR Entities or the Partnership Group
Scope of Prohibition. Except as provided in this Article II and in the MLP Agreement or the Holdings Agreement, the Partnership Parties and Holdings shall be free to engage in any business activity whatsoever, including those that may be in direct competition with each other.
