Sanitary Sewer Main. The sanitary sewer main will be installed by the Developer in Phases. The Developer shall extend and install an eight-inch (8”) sanitary sewer main, with lateral stubs extending to the edge of the right-of-way so as to provide sanitary sewer utility service to all lots within the Development, and to the farm homestead property that the Development surrounds, from the current terminus of the Village’s sanitary sewer system located south of WIS 60 to the Development, and within the Development itself. Notwithstanding anything within this Agreement to the contrary, the Village hereby expressly agrees that it shall pay the material cost difference between an eight-inch (8”) pipe and a ten- inch (10”) pipe in the event a ten-inch (10”) pipe is required as part of the Village approval of the Public Improvements plans.

Sanitary Sewer Main. The PROPERTY OWNER shall install ten-inch sanitary sewer main at the PROPERTY OWNER’S cost. The VILLAGE shall pay the material cost difference between the eight-inch pipe and the ten-inch pipe.
Sanitary Sewer Main. The sanitary sewer main will be installed by the Developer in Phases. The Developer shall extend and install an eight-inch (8”) and ten-inch (10”) sanitary sewer main as shown on the plans approved by the Village Engineer, with lateral stubs extending to the edge of the right-of-way so as to provide sanitary sewer utility service to all lots within the Development, to the proposed park (at such time as the park design is finalized), and to the farm homestead property that the Development surrounds. The sewer main will extend from the current terminus of the Village’s sanitary sewer system located east of the Development on Cedar Creek Road to the Development, extend through easements (allowing access to the Village for maintenance) within the north half of the concept plan and within the Development itself. At such time that the properties adjacent to the portion of the sanitary sewer installed on Cedar Creek Road are annexed into the Village, the Village shall levy a special assessment for a pro-rated portion of the original installation cost of the Cedar Creek Road portion upon said property that is to be served. Final costs shall be provided by the Developer and included in this Agreement as Exhibit E: Cedar Creek Road Sanitary Sewer Costs. The special assessment payment shall then be forwarded onto the Developer as a reimbursement for their installation costs incurred.
