Sanctions for Violations. 8.1 Transnet shall also take all or any one of the following actions, wherever required to: a) Immediately exclude the Bidder / Supplier from the bidding process or call off the pre-contract negotiations without giving any compensation to the Bidder / Supplier. However, the proceedings with the other Bidders / Suppliers may continue; b) Immediately cancel the contract, if already awarded or signed, without giving any compensation to the Bidder / Supplier; c) Recover all sums already paid by Transnet; d) Encash the advance bank guarantee and performance bond or warranty bond, if furnished by the Bidder / Supplier, in order to recover the payments, already made by Transnet, along with interest; e) Cancel all or any other contracts with the Bidder / Supplier; f) Exclude the Bidder / Supplier from entering into any bid with Transnet and other organs of state in future for a specified period; and g) If the Supplier subcontracted a portion of the bid to another person without declaring it to Transnet, Transnet must penalise the Supplier up to 10% of the value of the contract.
