The SAFETY SWITCH clause establishes a mechanism that allows for the immediate suspension or modification of certain obligations or activities under a contract when specific safety concerns arise. In practice, this clause typically empowers one or both parties to halt operations, such as construction work or equipment use, if unsafe conditions are detected or if there is a risk to health and safety. Its core function is to prioritize the well-being of individuals involved in the contract by providing a clear process for responding to hazardous situations, thereby reducing the risk of accidents and liability.
SAFETY SWITCH. (a) If applicable, in this clause “approved safety switch” refers to an approved safety switch under Part 6, Division 4 of the Electrical Safety Regulation 2013 (“Electricity Regulations”) and the terms used have the meanings as defined in the Electricity Regulations.
(b) If there is an approved safety switch installed for the general purpose of socket-outlets in the Improvements, the Seller makes no representations about the condition, quality or working order of the approved safety switch.
