ROOF PENETRATIONS. If improvements penetrate the roof membrane, the penetrations will be sealed per Landlord/IRC roofing specifications and inspected by IRC to maintain roof warranty. The cost of inspection and all corrective work shall be borne by Tenant. Tenant shall use Landlord's original roofing contractor.

ROOF PENETRATIONS. Tenant agrees that neither it nor its contractors or employees will, during the construction of the Leased Premises or at any time during the term of this Lease, make or cause to be made in the roof of the Leased Premises any penetration whatsoever without first obtaining the prior written approval from Landlord. Tenant acknowledges that Landlord may require Tenant to use Landlord’s designated roofing contractor to perform or supervise any roof cuts or penetrations to which Landlord may agree or give its consent. In the event Tenant fails to observe this condition, Landlord may hire a roofing contractor of its choice to inspect any penetrations in the roofing material over the Leased Premises and to perform any needed modifications or corrections to the roof surface or its components in order to preserve the integrity of the roof structure. Landlord may xxxx Tenant for the expenses of any such roof inspection and/or repairs, plus a 20% overhead fee for such work. Tenant agrees to pay for said inspection and/or repairs immediately upon presentation of said invoice.
ROOF PENETRATIONS. Landlord must approve all roof top equipment installations. All penetrations must be cut, flashed and sealed by the roof warranty holder or other vendor approved by property manager. Cost of such work shall be the sole responsibility of the Tenant/General Contractor
ROOF PENETRATIONS. Subject to the terms and conditions of this Lease, including, without limitation, Section 6, Tenant shall submit detailed plans to Landlord for, approval prior to any penetrations or alterations being made in the roof system. Conduits, pipes or wires must be concealed between the ceiling and the bottom of the roof deck and shall not be allowed to run across the roof surface. The roofing contractor, who shall be subject to Landlord's prior review and approval, which shall not be unreasonably withheld, shall properly install pitch pans and roof curbs at all roof penetrations and provide in writing either a l5 year complete water tight guarantee covering the work performed or a guarantee that the existing roof warranty has not been voided or compromised in any way as a result of Tenant's work. Tenant hereby agrees to indemnify, defend and hold Landlord hann1ess from any damage 'to the Building resulting, directly or indirectly, from Tenant's venting, opening, sealing, waterproofing or in any other way altering the roof unless such a guarantee from Landlord's roofing contractor (if applicable) or an authorized contractor has been delivered to Landlord promptly following the time said Alterations on the roof were performed.
ROOF PENETRATIONS. Tenant will coordinate with Landlord any installation of equipment and any penetrations needed on roof. Tenant shall be responsible for damage to roof coating caused by Tenant’s servicing of equipment or penetration of roof without Landlord’s prior written approval.
ROOF PENETRATIONS. Subject to Landlord’s approval, which shall not be unreasonably withheld, conditioned or delayed, Tenant shall have the right to repair and service Tenant’s existing HVAC equipment on the roof of the Building and to replace such equipment in the same location and to add new equipment that is substantially similar in size and function, except as provided in the next succeeding sentence. Tenant shall not install any new HVAC equipment on the lower, front, roof of the Building (commonly called the “view roof”) or make any new penetrations on that portion of the roof of the Building (collectively, “New Lower Roof Equipment and Penetrations”) without Landlord’s prior written consent to the location, design, materials and installation method thereof, which consent Landlord reserves the right to withhold for any reason in Landlord’s sole and absolute discretion. In the event that Landlord approves any roof penetrations (whether New Lower Roof Penetration or any others), (i) Tenant shall be solely responsible for obtaining any and all permits and approvals required in connection with installation of such penetrations and the ongoing maintenance thereof, and for any and all costs in connection with the permitting, fabrication, installation and maintenance of such penetrations, (ii) Tenant shall maintain all such penetrations in good condition at all times, and (iii) at the expiration or earlier termination of the Lease, Tenant shall remove all such penetrations, repair all damage caused by such removal, and restore the roof of the Building to its condition immediately prior to installation of all such penetrations.
ROOF PENETRATIONS. Tenant shall have the non-exclusive right to install a roof-top telecommunications equipment serving the Premises on the roof of the Building, provided that: (i) plans and specifications including details as to visibility and method of roof penetration are prepared at Tenant's expense and submitted to Landlord for prior approval; (ii) all costs and expense of any such installations are borne by Tenant; (iii) Tenant releases Landlord from any and all liability or loss incurred by Tenant, its officers, employees, agents and contractors, and other tenants within the Building as a result of any leaks in the roof or loss or damages to the facilities so installed; (iv) Tenant shall use only those licensed, reputable and insured contractors for the installation of such telecommunications equipment; (v) Landlord reserves the right to relocate the Tenant's roof-top equipment, at Landlord's expense, in the event such relocation is necessary or desirable in connection with alterations, expansions or renovations of the Building or Property; (vi) the installation and use of such roof-top equipment shall not unreasonably interfere with the use and quiet enjoyment of the Building by any other person or entity occupying any portion of the Building, and if requested by Landlord, Tenant shall install at its expense sound barriers for its roof-top equipment; (vii) all roof-top equipment installed by or on behalf of Tenant shall be maintained by Tenant at its cost and expense in good operating condition; (viii) Tenant's roof-top equipment shall not be visible above any parapet of the Building; (ix) all roof penetrations shall be appropriately flashed in a manner satisfactory to Landlord at Tenant's cost and expense; (x) Tenant's installation of such equipment shall be subject to all applicable governmental laws, rules and regulations and Tenant shall obtain and keep in force any required permits or other governmental authorizations required in connection with such equipment; and (v) Tenant shall, at its expense, promptly remove such roof-top equipment at its sole cost and expense at the expiration or earlier termination of the Term and shall promptly repair and restore all damage to the Building caused by the installation and removal of such roof-top telecommunications equipment.

ROOF PENETRATIONS. If Lessee's Work, Lessee Owned Alterations and/or Utility Installations require any penetration of the roof structure, roof membrane, or roof cover of the Premises, Lessee shall: (a) at its sole cost and expense make any necessary repairs caused as result of said work utilizing a roofing contractor which contractor is satisfactory to Lessor and Lessee; and, (b) provide a new roof warranty from a bona fide, responsible roofing contractor acceptable to Lessor if any existing roof warranty is voided by such penetrations. Upon the expiration or sooner termination of this Lease, Lessor shall have the right to require Lessee at Lessee's sole cost and expense to remove such roof penetrations and restore the roof to the condition in which it was in upon the commencement of the Original Term hereof, less reasonable wear and tear.

ROOF PENETRATIONS. Tenant shall not penetrate the roof of the Demised Premises without Landlord’s prior written consent. Tenant shall be responsible for the repair of roof leaks caused by such penetration even though Tenant has obtained Landlord’s prior written consent thereto.
