Rolling Stock Procurement. It is proposed that the Franchisee shall obtain rolling stock to enable it to deliver the services required by Major Projects. The Franchisee and Scottish Ministers are currently discussing a Variation to the franchise which would require the Franchisee to manage the procurement of that rolling stock and possibly third party finance. The Franchisee may be funded to do this using money provided under paragraph 1.4 of Appendix 1 to this Amendment Agreement.

The Variation will also deal with the funding ofthe Franchisee's rights to use that Rolling Stock.
