RIGHTS OF OWNERSHIP; RETURN OF RECORDS. All records and other data except computer programs and procedures developed to perform services required to be provided by Ultimus are the exclusive property of the Trust and all such records and data will be furnished to the Trust in appropriate form as soon as practicable after termination of this Agreement for any reason. Ultimus may at its option at any time, and shall promptly upon the Trust's demand, turn over to the Trust and cease to retain Ultimus' files, records and documents created and maintained by Ultimus pursuant to this Agreement which are no longer needed by Ultimus in the performance of its services or for its legal protection. If not so turned over to the Trust, such documents and records will be retained by Ultimus for six years from the year of creation. At the end of such six-year period, such records and documents will be turned over to the Trust unless the Trust authorizes in writing the destruction of such records and documents.

If not so turned over to the Trust, such documents and records will be retained by CQFS for six years from the year of creation. At the end of such six-year period, such records and documents will be turned over to the Trust unless the Trust authorizes in writing the destruction of such records and documents. If destruction of documents is authorized by the Trust, CQFS shall provide reasonable proof of such destruction to the Trust.

If not so turned over to the Trust, such documents and records will be retained by AIFS for six years from the year of creation. At the end of such six-year period, such records and documents will be turned over to the Trust unless the Trust authorizes in writing the destruction of such records and documents.

ASTFS may at its option at any time, and shall promptly upon the Fund's demand, turn over to the Fund and cease to retain ASTFS' files, records and documents created and maintained by ASTFS pursuant to this Agreement which are no longer needed by ASTFS in the performance of its services or for its legal protection. If not so turned over to the Fund, such documents and records will be retained by ASTFS for six years from the year of creation. At the end of such six-year period, such records and documents will be turned over to the Fund unless the Fund authorizes in writing the destruction of such records and documents.
RIGHTS OF OWNERSHIP; RETURN OF RECORDS. Except for computer software, programs and procedures, whether or not customized for the Trust or one of its Portfolios, developed to perform services required to be provided by CMFS under this Agreement, all books and records maintained by CMFS in connection with its services under this Agreement are the exclusive property of the Trust and all such records and data will be furnished to the Trust in appropriate form as soon as practicable after termination of this Agreement for any reason. CMFS may at its option at any time, and shall promptly upon the Trust's demand, deliver to the Trust, at the Trust's expense, and cease to retain CMFS books and records created and maintained by CMFS pursuant to this Agreement which are no longer needed by CMFS in the performance of its services or for its legal protection. CMFS shall be entitled to maintain a copy of the Trust's books and records to the extent necessary for CMFS to fulfill its regulatory obligations. If such books and records are not delivered in accordance with this paragraph, CMFS will maintain such books and records in accordance with applicable record keeping requirements from the date such books and records were created. At the end of such retention period, such books and records will be delivered to the Trust at the Trust's expense unless the Trust instructs CMFS in writing to destroy such books and records. Any such destruction will be at the Trust's expense. If destruction of books and records is instructed by the Trust, CMFS shall provide reasonable proof of such destruction to the Trust. Any such destruction authorization shall be evidenced by a certified resolution of the Trust's Board of Trustees. The Trust shall indemnify and hold harmless CMFS in accordance with Paragraph 8 of this Agreement for any loss, claim or expense (including, but not limited to, reasonable attorneys' fees) in connection with CMFS' compliance with an instruction to destroy any books and records pursuant to this paragraph.

If not so turned over to the Trust, such documents and records will be (1) copied and made available to the Trust by Xxxxxxx as soon as reasonably practical, and (2) retained by Xxxxxxx for six years from the year of creation. At the end of such six-year period, such records and documents will be turned over to the Trust unless the Trust authorizes in writing the destruction of such records and documents.
RIGHTS OF OWNERSHIP; RETURN OF RECORDS. All records and other data, except computer programs and procedures developed by us to perform services required of us under this Agreement are your exclusive property, and we will return to you all such records and data in an appropriate form as soon as practicable after termination of this Agreement. Any documents, books, records or other writings which we maintain for you will be retained by us for such periods and in such manner as required under the 1940 Act. At the end of any such period, we will return all such documents, books, records or other writings to you unless you authorize us, in writing, to destroy them. If you instruct us to destroy any or all such documents, books, records or other writings, we shall provide reasonable proof of their destruction to you.

The Transfer Agent may at its option at any time, and shall promptly upon the Trusts' demand, turn over to the Trusts and cease to retain the Trusts' files, records and documents created and maintained by the Transfer Agent pursuant to this Agreement which are no longer needed by the Transfer Agent in the performance of its services or for its legal protection or as otherwise required by law. If not so turned over to the Trusts, (1) such documents and records will be copied and complete copies shall be delivered to the Trusts by the Transfer Agent as soon as reasonably practical, and (2) the original documents and records will be retained by the Transfer Agent for six years from the year of creation. At the end of such six-year period, such records and documents will be turned over to the Trusts unless the Trusts authorize in writing the destruction of such records and documents.

RiskX Investments may at its option at any time, and shall promptly upon the Trust's demand, turn over to the Trust and cease to retain RiskX Investments’ files, records and documents created and maintained by RiskX Investments pursuant to this Agreement which are no longer needed by RiskX Investments in the performance of its services or for its legal protection. If not so turned over to the Trust, such documents and records will be retained by RiskX Investments for six years from the year of creation. At the end of such six-year period, such records and documents will be turned over to the Trust unless the Trust authorizes in writing the destruction of such records and documents.
