RIGHT TO SUE. ▇ach Party shall promptly inform the other of any suspected infringement of any Patent Rights or misuse, misappropriation, theft or breach of confidence of other proprietary rights in the Technology by a Third Party. With respect to such activities as are suspected and if such activities are a violation of ILEX's rights, ILEX shall have the right, but not the obligation, to bring suit against a Third Party for infringement, misuse, misappropriation, theft or breach of confidence of the proprietary rights against such Third Party. ILEX, if required by law, may join TBI as a Party to the suit at ILEX's expense. In the event that ILEX prosecutes any such lawsuit, then ILEX shall be entitled to deduct its costs and expenses from any damages it is awarded. Any remaining damage awarded shall be divided seventy-five percent (75%) to ILEX and twenty-five percent (25%) to TBI. Before any action is taken that will affect the validity of any rights (including the Patent Rights) or before such lawsuit is settled or compromised, the Parties shall consult and cooperate with one another to insure that the rights granted by this Agreement (including the Patent Rights) are not materially affected by any such acts, settlement or compromise. TBI shall cooperate fully in any such lawsuit and shall not take or omit any significant action which would interfere with ILEX's prosecution of such a lawsuit.

RIGHT TO SUE. Subject to Section 6.14 below, Mortgagee shall have the right from time to time to sue for any sums required to be paid by Mortgagor under the terms of this Mortgage as the same become due, without regard to whether or not the entire Loan Obligations shall be, or have become, due and without prejudice to the right of Mortgagee thereafter to bring action or proceeding of foreclosure or any other action upon the occurrence and continuance of any Event of Default existing at the time such earlier action was commenced.

RIGHT TO SUE. Licensor shall promptly notify Licensee if it learn th▇▇ an entity may be infringing Licensee's exclusive rights to the Licensed Patent. Licensee shall promptly notify Licensor if it learns that an entity may be infringing the Licensed Patent. Initially, Licensor shall have the right to contact the suspected infringer and, if the situation warrants, to file a lawsuit against the suspected infringer. If Licensor does file suit against a suspected infringer, Licensor shall have sole control of the lawsuit, to the exclusion of Licensee, and shall be entitled to all money and other compensation received as a result of the lawsuit. Licensee shall cooperate with Licensor, at Licensor's expense, in the lawsuit. Licensee shall not be responsible for any costs or fees associated with any lawsuit initiated by Licensor. If, after having a reasonable amount of time to evaluate the suspected infringement of the Licensed Patent, Licensor declines to file a lawsuit against the suspected infringer, Licensee may file such a lawsuit if the suspected infringer is using the technology described and claimed in the Licensed Patent with respect to poultry. Before filing such a suit, Licensee shall consult with Licensor and give notice to Licensor of its intention to initiate litigation concerning the Licensed Patent. In the event Licensee files a lawsuit against a suspected infringer, Licensee shall have sole control of the lawsuit, to the exclusion of Licensor, and shall be entitled to all money and other compensation received as a result of the lawsuit. Licensor shall, however, be allowed to participate in the lawsuit and Licensee shall keep Licensor well informed as to the status of the lawsuit. Licensor shall cooperate with License, at Licensee's expense, in the lawsuit. Licensor shall not be responsible for any costs or fees associated with any lawsuits initiated by Licensee.

RIGHT TO SUE. A statute may not abridge and a law enforcement agency may not adopt a regulation that prohibits the right of a law enforcement officer to bring suit that arises out of the law enforcement officer's duties as a law enforcement officer.

RIGHT TO SUE. In accordance with the terms of the Indenture, the Mortgagee shall have the right from time to time to sue for any sums required to be paid by the Mortgagor under the terms of this Mortgage as the same become due, without regard to whether or not the Obligations shall be, or have become, due and without prejudice to the right of the Mortgagee thereafter to bring any action or proceeding of foreclosure or any other action upon the occurrence of any Default existing at the time such earlier action was commenced.
