RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant Provider an exclusive right to provide services to Company, and Company retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services or for the use of facilities as are available to or have been requested by Company pursuant to this Agreement.
RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant the Provider an exclusive right to provide services to the Recipient, and the Recipient retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services or for the use of facilities as are available to or have been requested by the Recipient pursuant to this Agreement. The Providers, with the Recipient’s consent, shall have the right to subcontract with any third party, affiliated or unaffiliated, for the performance of services requested by the Recipient provided that the Provider shall remain responsible for the performance of services by any such subcontractors in accordance with the terms of this Agreement; and provided further that the charges for any such services subcontracted to an affiliate shall be determined on the basis described in Section 3. With respect to significant services that are subcontracted, this Agreement shall be amended and filed with the New York Insurance Department for appointing/changing a subcontractor or changing subcontractor services.
RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant either Party an exclusive right to provide services to the other Party, and each Party retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services or for the use of facilities as are available to or have been requested pursuant to this Agreement. Nothing herein shall be deemed to prohibit either Party from providing any or all of the Services to be provided under this Agreement to other persons, whether or not affiliated with Xxxxxxx or the Funds.
RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant Parent an exclusive right to provide services to Company, and Company retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services or for the use of facilities as are available to or have been requested by Company pursuant to this Agreement. Nothing herein shall be deemed to prohibit Parent from providing any or all of the services to be provided to Company hereunder to other persons, whether or not affiliated with Parent. In addition, Company shall have the right to solicit bids and contract with any third party for the services to be provided hereunder, in which event this Agreement may be terminated in accordance with Section 9 hereof. Further, Parent has right to subcontract with any third party, affiliated or unaffiliated, for services Parent is obligated to provide to Company pursuant to this Agreement.
RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant Advisor an exclusive right to provide services to Company, and Company retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services as are available to or have been requested by Company pursuant to this Agreement. It is also understood and agreed that Advisor's services are not exclusively for Company. Advisor shall remain free to provide services to other persons, pursuant to objectives which may or may not be similar to the strategy adopted as appropriate for Company.
RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant Service Provider an exclusive right to provide services to Service Recipient, and Service Recipient retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services or for the use of facilities as are available to or have been requested by Service Recipient pursuant to this Agreement. Service Provider, with Service Recipient’s consent, which shall not be unreasonably withheld, shall have the right to subcontract with any third party, affiliated or unaffiliated, for the performance of services requested by Service Recipient provided that Service Provider shall remain responsible for the performance of services by any such subcontractors in accordance with the terms of this Agreement; and provided further that the charges for any such services subcontracted to an affiliate shall be determined on the bases described in ARTICLE VI.

Nothing herein shall be deemed to grant the Service Provider an exclusive right to provide services to the Company, and the Company retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services or for the use of facilities as are available to or have been requested by the Company pursuant to this Agreement. The Service Provider, unless the Company objects, shall have the right to subcontract with any third party, affiliated or unaffiliated, for the performance of services requested by the Company under this Agreement, provided that the Service Provider shall remain responsible for the performance of services by any such subcontractors in accordance with the terms of this Agreement; and provided further that the charges for any such services subcontracted to an affiliate shall be determined on the basis described in Section 3 above.
RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant to GENWORTH, GNA or GECC an exclusive right to provide the services described herein to a Client, and each Client retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services or for the use of facilities as are available to or have been requested by such Client pursuant to this Agreement; provided, however, GECC Treasury shall exclusively execute all derivatives transactions of any subsidiary with which GECC has direct or indirect voting control in accordance with the GECC Derivatives Policy.
RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant AAG an exclusive right to provide Services to AILIC, and AILIC retains the right to contract with any third party, affiliated or unaffiliated, for the performance of Services or for the use of Facilities as are available to or have been requested by AILIC pursuant to this Agreement. Similarly, AAG retains the right to contract with any third party, affiliated or unaffiliated, to perform services or to provide facilities, identical or similar to those being performed or provided herein.
RIGHT TO CONTRACT WITH THIRD PARTIES. Nothing herein shall be deemed to grant Provider an exclusive right to provide services to Company, and Company retains the right to contract with any third party, affiliated or unaffiliated, for the performance of services or for the use of facilities as are available to or have been requested by Company pursuant to this Agreement. 8. CONTACT PERSON(S). Company and Provider each shall appoint one or more individuals who shall serve as contact person(s) for the purpose of carrying out this Agreement. Such contact person(s) shall be authorized to act on behalf of their respective parties as to the matters pertaining to this Agreement. Each party shall notify the other, in writing, as to the name, address and telephone number for any such designated contact person, and of any replacement thereof. 9.
