RFE/EMI STANDARDS. Nortel represents and warrants that any Product sold to Distributor pursuant to this Agreement which is subject to, and not exempted by, Part 15, Subpart A & B of the Rules and Regulations of the Federal Communications Commission in effect at the time of sale, will comply with the requirements in Part 15, Subpart A & B of the Rules and Regulations of the Federal Communications Commission. In the event of a breach of the warranty of this Section 4.1.3, a condition precedent to any duty on the part of Nortel to remedy the breach and to the indemnity stated herein shall be that the Product was installed within the Distributor's Territory in accordance with the terms of this Agreement.
