Revenue Service. Each Employee Plan which is not a Multiemployer Plan has been maintained in substantial compliance with its terms and with the requirements prescribed by any and all applicable statutes, orders, rules and regulations, including but not limited to ERISA and the Code. No Employee Plan is a Multiemployer Plan.

Revenue Service. ‌ VMR will have an annual stray current monitoring program to identify stray current which may be emanating from the rail system. The streetcar track slab will be vacuum broomed no less than once a month or more often as necessary to keep the flangeway and track clean and free of debris. Tempe is responsible for vacuum brooming the guideway. The track will be inspected on an ongoing basis by VMR staff to identify problem areas of the rail, rail-boot assembly, and switch areas. Block outs for switch machines, impedance bonds, and cross-bonding will be inspected to insure the drainage pathway is clear of debris which could impede drainage of storm water.
