Return to Active Status Sample Clauses

Return to Active Status. Upon completion of FMLA leave for the employee’s own health condition, the City may require the employee to provide a certification of fitness to return to work. After FMLA leave, most employees are entitled to return to their same job or an equivalent position with equivalent pay, benefits and other terms of employment. The use of FMLA leave will not result in the loss of any employment benefit that accrued prior to the start of an FMLA leave, however, no benefits other than health care benefits will continue to accrue during FMLA leave. The City may recover the costs of premiums paid to maintain an employee’s health insurance, or other types of insurance, if the employee fails to return to work from FMLA leave.
