Resultant Data. Subject to the terms of this XXXX, the Company grants you a perpetual, non-exclusive, non-transferable, and non- sublicenseable right to use, solely by the Customer or an Authorized User, the Resultant Data.

Resultant Data. Client hereby agrees that VFA and its successors and assigns may collect, use, publish, disseminate, sell, transfer, and otherwise exploit the collected Usage Data only if such data (i) has been anonymized by VFA or its designee; or (ii) is aggregated with Usage Data from other Clients. For the avoidance of doubt, such anonymized and aggregated Usage Data will be considered a part of Resultant Data as set forth in the Agreement. Resultant Data is used by VFA to compile statistical, performance information for creation and development of products, product improvements, product creation, and product marketing. VFA is the sole owner of all right, title, and interest in and to Resultant Data and any conclusions, impressions, understandings, insights, process improvements, or other information derived, extracted, or otherwise obtained by VFA from Resultant Data, and the Resultant Data shall be owned exclusively by VFA with all rights thereto, which shall be deemed VFA’s Intellectual Property for purposes of this Agreement.
Resultant Data. Notwithstanding anything to the contrary in this Agreement, Provider may monitor Customer's use of the Services and collect and compile Resultant Data. As between Provider and Customer, all right, title, and interest in Resultant Data, and all intellectual property rights therein, belong to and are retained solely by Provider. Customer acknowledges that Provider may compile Resultant Data based on Customer Data. Customer agrees that Provider may (i) make Resultant Data publicly available in compliance with applicable law, and (ii) use Resultant Data to the extent and in the manner permitted under applicable law; provided that in either case such Resultant Data do not identify Customer or Customer's Confidential Information. 3. Customer Responsibilities. Customer is responsible and liable for all uses and disclosures of Customer Data and all uses of the Services and Documentation resulting from access provided by Customer, directly or indirectly, whether such access or use is permitted by or in violation of this Agreement. Without limiting the generality of the foregoing, Customer is responsible for all acts and omissions of Authorized Users or any Person using a password or login credentials assigned to an Authorized User, and any act or omission by an Authorized User or such Person that would constitute a breach of this Agreement if taken by Customer will be deemed a breach of this Agreement by Customer. Customer shall use reasonable efforts to make all Authorized Users aware of this Agreement's provisions as applicable to such Authorized User's use of the Services, and shall cause Authorized Users to comply with such provisions.
Resultant Data. Notwithstanding anything to the contrary set forth herein, BookNook shall have the right to collect and analyze Resultant Data, and BookNook will be free (during and after the Term hereof) to (i) use such Resultant Data to improve and enhance the BookNook Solution and for other development, diagnostic and corrective purposes in connection with the BookNook Solution and other BookNook offerings; (ii) disclose such data solely in an aggregated and de-identified form in connection with its business (including for marketing purposes); and (iii) disclose such Resultant Data to Customer’s funders and/or key stakeholders so long as such Resultant Data is de-identified so as not to identify any individual students.
Resultant Data. Notwithstanding anything to the contrary in this Agreement, CLOCworks may monitor Customer’s use of the CLOCworks Solutions and collect and compile Resultant Data. As between CLOCworks and Customer, all right, title, and interest in Resultant Data, and all Intellectual Property Rights therein, belong to and are retained solely by CLOCworks. Customer acknowledges that CLOCworks may compile Resultant Data based on Customer Data input into the CLOCworks Solutions. Customer agrees that CLOCworks may (i) make Resultant Data publicly available in compliance with applicable Law, and (ii) use Resultant Data to the extent and in the manner permitted under applicable Law; provided that such Resultant Data does not identify Customer or Customer’s Confidential Information.
Resultant Data. Resultant Data means data and information related to Your use of the Services that CloudCheckr uses in an aggregate and anonymized manner, including to compile statistical and performance information related to the provision and operation of the Services. CloudCheckr uses this data, without limitation, to improve the performance of the Services or develop important updates. CloudCheckr never uses it to re-identify You. In furtherance of the foregoing, You hereby unconditionally and irrevocably grant CloudCheckr an assignment of all right, title, and interest in and to the Resultant Data, including all intellectual property rights relating thereto.
Resultant Data. You hereby grant Ubicquia a nonexclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable right to access, display, process, aggregate, create Derivative Works (defined below), or otherwise use Aggregate Data (defined below) (including all related intellectual property rights) in any manner and without payment of any royalties. For the purposes of these Terms: (i) “Aggregate Data” means data, including Your Data, in which identification (or re- identification) of an individual person or organization is not technically possible according to acceptable commercial standards of protection, and considering all means that could reasonably be used; and (ii) “Derivative Work” means a derivative work within the meaning of the Copyright Act of 1976 (as amended) including, without limitation, any modification, revision, translation, abridgment, condensation, or expansion of the associated content or any form in which the associated content is recast, transferred, transformed, or adapted, which, if prepared without the rights granted under this Agreement, would result in copyright infringement.

Resultant Data. Notwithstanding anything to the contrary in this Agreement, you acknowledge and agree that we shall have the right to collect and analyze data and other information relating to the provision, use and performance of various aspects of the Canvas Platform and its related systems and technologies (including, without limitation, information concerning data derived from Your Content) (collectively, “Resultant Data”). Resultant Data includes statistics, statistical models, parameters, algorithms, and other similar information and data generated from the operation of the Canvas Platform and derived from Your Content. We are free (during and after the term of this Agreement) to (i) use such Resultant Data to improve and enhance the Canvas Platform and for other development, diagnostic and corrective purposes in connection with the Canvas Platform and our other products or services and (ii) disclose such Resultant Data to third parties.
Resultant Data. “Resultant Data” means data and information related to Service Provider’s use of the Platform that is used by TipTop in an aggregate and de-identified manner to compile statistical and performance information related to the provision, use and operation of the Platform. Service Provider hereby unconditionally and irrevocably grants TipTop an assignment of all right, title and interest in and to the Resultant Data, including all intellectual property rights related to such data.
Resultant Data. Notwithstanding anything to the contrary in this TOS, Submittable may monitor Customer’s use of the Services and collect and compile Resultant Data. Resultant Data must be used in a manner where such use cannot reasonably lead to the identification of any Customer, Authorized User, or End User. Submittable may use Resultant Data for statistical and performance information, optimization information, debugging, feature development, performance analytics and optimization, and marketing insights or reports related to the provision and operation of the Services.
