Restaurant Lease. The Lease Agreement and Indenture of Lease, each dated November 9, 1994, as amended by a certain First Amendment to Lease dated May 3, 1995, and further amended by a certain Second Amendment to Lease, by and between Philxx X. Xxxxxxx, Xxustee, and Borrower, as now Lessor and Lessee respectively, together with all amendments thereto hereafter expressly approved, in writing, by Lender in accordance with the provisions of this Agreement.

Restaurant Lease. Evidence that the Restaurant Lease is in full force and effect and the Lessor and Borrower thereunder are in full compliance with the provisions of the Restaurant Lease.
Restaurant Lease. The Restaurant Lease is a legal, valid and binding obligation of the parties thereto enforceable against them in accordance with its terms and is in full force and effect and Borrower is not, and to Borrower's knowledge the landlord thereunder is not, in default of any term or provision thereof, including without limitation Borrower's compliance with the construction schedule contained therein. There have been no threatened cancellations of the Restaurant Lease nor any material disputes thereunder. A true and complete copy of the Restaurant Lease is attached hereto as Schedule 5.6 and made a part hereof, and there are no modifications, supplements or waivers of any provision contained therein.
Restaurant Lease. As used herein, "Restaurant Lease" shall have the ---------------- meaning ascribed to such term in the Deed of Trust.

Restaurant Lease. The lease by and between the Developer and the Restaurant Operator for the lease of the Restaurant Development by the Restaurant Operator from the Developer, or such other legally binding agreement, including but not limited to a ground lease, between the Developer and the Restaurant Operator governing the Restaurant Operator's use and occupancy of the Restaurant Development.
Restaurant Lease. Promptly following the City's approval of the Restaurant Commitment and the Restaurant Operator, the Developer shall negotiate the terms of the proposed Restaurant Lease and shall submit such lease to the City for the City's limited review and approval prior to execution. The City shall review the proposed Restaurant Lease pursuant to the process set forth in subsection (2), above, provided; however, the City may only disapprove of such proposed Restaurant Lease in the event such lease is not consistent with the terms of the Restaurant Commitment previously approved by the City.
