Responsibility of BUILDER. Builder shall be responsible for the storing and handling with reasonable care of Buyer’s Supplies after delivery thereof to the Shipyard, and shall, at its own cost and expense, install them in or on the Vessel, unless otherwise provided herein or agreed by the parties hereto, provided, always, that Builder shall not be responsible for quality, efficiency and/or performance of any of Buyer’s Supplies and for the loss of or damage to Buyer’s Supplies caused without Builder’s wilful misconduct or gross negligence.

It will be the BUILDER’s responsibility to the BUYER to: (i) if applicable, assemble the BUYER’s Supplies; (ii) test the BUYER’s Supplies as necessary or appropriate; (iii) install the BUYER’s Supplies on the DRILLSHIP, in modules, as required, or otherwise as required, and to integrate the BUYER’s Supplies into the overall designed system of the DRILLSHIP. In no event will BUILDER charge any additional cost for any of the above. The BUILDER will perform above works under guidance of BUYER and the Vendors representative when required. Any rework involved due to no fault of the BUILDER shall be to BUYER’s cost and responsibility.

The Builder shall not in any way be responsible for the quality, efficiency and/or performance and/or commissioning and testing of any of the Buyer’s Supplies. In addition, and unless the Builder confirmed in writing the inter-face design prior to the Buyer’s ordering of the relevant Buyer’s Supplies, the Builder shall bear no responsibility or liability for the inter-face design or any part hereof. Title to Buyer’s Supplies shall at all times remain with Buyer.
Responsibility of BUILDER. (a) BUILDER personnel and subcontractors which, in the sole opinion of OWNER, are found to be in violation of the safety policies established by BUILDER or those specially in place during the construction of the VESSEL, may be requested to be removed from the project by the OWNER's Supervisor. BUILDER will immediately take such actions as necessary to comply with OWNER's reasonable request.

Responsibility of BUILDER. The BUILDER shall be responsible for storing and handling with reasonable care of the BUYER's Supplies after delivery thereof at the Shipyard, and shall, at its own cost and expense, install them in or on the DRILLSHIP, unless otherwise provided herein or agreed by the parties hereto, provided, always, that the BUILDER shall not be responsible for quality, efficiency and/or performance of any of the BUYER's Supplies (other than to install same in accordance with the manufacturer's specifications and requirements, copies of which have been provided to BUILDER by BUYER). It will be the BUILDER's responsibility at no cost to BUYER to: (i) assemble the BUYER's Supplies, bulk material and provide modularization and integration engineering, except procurement engineering related to the BUYER's Supplies, at the Shipyard; (ii) test the BUYER's Supplies as necessary or appropriate; (iii) construct modules from the BUYER's Supplies as appropriate; (iv) test and pre-commission the modules containing the BUYER's Supplies and to generally test all of the BUYER's Supplies; (v) install the BUYER's Supplies on the DRILLSHIP, in modules, as required, or otherwise as required, and to integrate the BUYER's Supplies into the overall designed system of the DRILLSHIP; (vi) test and pre- commission the integrated modules and systems; and (vii) complete and test the entire drilling system where practicable (i.e., equipment functional test only, not full operational load test) to insure that it works harmoniously as a part of the drilling process and the DRILLSHIP so as to be able to accomplish its intended purpose. In no event will BUILDER charge any additional cost for any of the above. Pre-commission or pre-commissioning as used in this Contract or the Specifications means the putting into service or the commissioning to be done at the Shipyard prior to delivery and acceptance. Pre-commission or pre-commissioning does not mean commissioning that occurs elsewhere.

However, Builder shall not be responsible for the quality, performance or efficiency of any equipment included in Buyer’s supplies and is under no obligation with respect to the guarantee of such equipment against any defects caused by poor quality, performance or efficiency of Buyer’s supplies provided that Builder or its subcontractor install the equipment properly.
