Common use of RESPONSIBILITY FOR AWARDS Clause in Contracts

RESPONSIBILITY FOR AWARDS. The Supplier acknowledges that each Contracting Authority is independently responsible for the conduct of its award of Contracts under this Dynamic Marketplace Agreement and that the Authority is not responsible or accountable for and shall have no liability whatsoever in relation to: the conduct of Other Contracting Authorities in relation to this Dynamic Marketplace Agreement; or the performance or non-performance of any Contracts between the Supplier and Other Contracting Authorities entered into pursuant to this Dynamic Marketplace Agreement.

The Supplier acknowledges that each Contracting Authority Body is independently responsible for the conduct of its award of Contracts Call Off Agreements under this Dynamic Marketplace Purchasing System Agreement and that the Authority is not responsible or accountable for and shall have no liability whatsoever in relation to: the conduct of Other Contracting Authorities Bodies in relation to this Dynamic Marketplace Purchasing System Agreement; or the performance or non-performance of any Contracts Call Off Agreements between the Supplier and Other Contracting Authorities Bodies entered into pursuant to this Dynamic Marketplace Purchasing System Agreement.
