In any case, such exercise has prospective effect on investors and their investments. What does the ECT mean by “substantial business”? The concept of “substantial business” is not defined by the ECT, but one can assume, based on the “mailbox company” typology, that such entity has no life of its own, i.e. existing only on papers, without engaging into any activity. Undoubtedly, such assessment should be conducted based on the specific facts of each case.
