Common use of Removal Requirement Clause in Contracts

Removal Requirement. If Post Acute Medical has actual notice that a Covered Person has become an Ineligible Person, Post Acute Medical shall remove such Covered Person from responsibility for, or involvement with, Post Acute Medical’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).

If Post Acute Medical any of the U.S. Healthcare Parties has actual notice that a Covered Person has become an Ineligible Person, Post Acute Medical the respective entity shall remove such Covered Person from responsibility for, or involvement with, Post Acute Medicalthe company’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).

If Post Acute Medical Dr. Pal and Interventional Cardiology has actual notice that a Covered Person has become an Ineligible Person, Post Acute Medical Dr. Pal and Interventional Cardiology shall remove such Covered Person from responsibility for, or involvement with, Post Acute MedicalDr. Pal and Interventional Cardiology’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care care‌ program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).

If Post Acute Medical has the Covered Entities have actual notice that a Covered Person has become an Ineligible Person, Post Acute Medical the Covered Entities shall remove such Covered Person from responsibility for, or involvement with, Post Acute Medical’s the Covered Entities’ business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).program(s).‌

If Post Acute Medical AmeriCare has actual notice that a Covered Person has become an Ineligible Person, Post Acute Medical AmeriCare shall remove such Covered Person from responsibility for, or involvement with, Post Acute MedicalAmeriCare’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).program(s).‌

If Post Acute Medical Healthquest, Inc. has actual notice that a Covered Person has become an Ineligible Person, Post Acute Medical Healthquest, Inc. shall remove such Covered Person from responsibility for, or involvement with, Post Acute MedicalHealthquest, Inc.’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).program(s).‌
