Common use of Removal Requirement Clause in Contracts

Removal Requirement. If Xxxxxx has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

Removal Requirement. If Xxxxxx Progenity has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Progenity shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Progenity’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Practitioner has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Practitioner shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Practitioner’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Healogics has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Healogics shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Healogics’ business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

Removal Requirement. If Xxxxxx Xx. Xxxxx has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xx. Xxxxx shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Xx. Xxxxx’x or the Cancer Centers’ business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

If Xxxxxx Provider has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Provider shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Provider’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Agendia has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Agendia shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Agendia’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

If Xxxxxx Xxxxx Pharmacy has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xxxxx Pharmacy shall remove such such‌ Covered Person from responsibility for, or involvement with, Xxxxxx’x Xxxxx Pharmacy’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).‌‌

If OC and Xxxxxx has have actual notice that a Covered Person has become an Ineligible Person, OC and Xxxxxx shall remove such Covered Person from responsibility for, or involvement with, OC and Xxxxxx’x business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Xxxx Clinic has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xxxx Clinic shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Xxxx Clinic’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Xxxxxxxx Clinic has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xxxxxxxx Clinic shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Xxxxxxxx Clinic’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

If Xxxxxx Xxxxx has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xxxxx shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Kelly’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Sutter has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Sutter shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

Removal Requirement. If Xxxxxx Xx. Xxxxxxx has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xx. Xxxxxxx shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Dr. Muttath’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the the‌ Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx I&L has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx I&L shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x I&L’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

Removal Requirement. If Xxxxxx has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Hanora’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).‌‌

Removal Requirement. If Xx. Xxxxxx has actual notice that a Covered Person has become an Ineligible Person, Xx. Xxxxxx shall remove such Covered Person from responsibility for, or involvement with, Xx. Xxxxxx’x or MRA’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

Removal Requirement. If Xxxxxx Xx. Xxxxxxxx has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xx. Xxxxxxxx shall remove such such‌ Covered Person from responsibility for, or involvement with, Xxxxxx’x Xx. Xxxxxxxx’x business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Align has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Align shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Align’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

If Xxxxxx Practitioner has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Practitioner shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Practitioner’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

If Xxxxxx Xxxx has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xxxx shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Xxxx’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌

If Xxxxxx Gamma has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Gamma shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Xxxxx’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and and‌ shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

Removal Requirement. If Xxxxxx Xx. Xxxxxxx has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xx. Xxxxxxx shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Dr. Xxxxxxx’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the the‌ Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Xxxxx Pharmacy has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xxxxx Pharmacy shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Xxxxx Pharmacy’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌program(s).

If Xxxxxx Millcreek has actual notice that a Covered Person has become an Ineligible Person, Xxxxxx Xxxxxxxxx shall remove such Covered Person from responsibility for, or involvement with, Xxxxxx’x Xxxxxxxxx’s business operations related to the Federal health care program(s) from which such Covered Person has been excluded and shall remove such Covered Person from any position for which the Covered Person’s compensation or the items or services furnished, ordered, or prescribed by the Covered Covered‌ Person are paid in whole or part, directly or indirectly, by any Federal health care program(s) from which the Covered Person has been excluded at least until such time as the Covered Person is reinstated into participation in such Federal health care program(s).‌
