Remedy for Failure of the Services Warranty. Upon receipt of written notice of a Services Warranty breach, Medallia will re‐perform the Services as necessary to correct the breach. If Medallia cannot correct the breach within forty‐five days from receipt of the warranty notice, then Ordering Entity may terminate the affected portion of the Order at any time within the next thirty days and receive a refund of Services fees paid for nonconforming or unperformed Services. This is Ordering Entity’s sole and exclusive remedy for a breach of the Services Warranty.
