Galveston Island Shrimp Festival reserves the right to use artist's images to advertise and promote Galveston Island Shrimp Festival. I understand that my slides/photos will not be returned. Applicant agrees to observe and comply with all applicable laws, statutes, ordinances, rules and regulations. Applicant assumes all costs and liability arising from the use of patented, trademarked, copyrighted or service marked materials, equipment, processes or creative rights. Applicant shall not assign or attempt to sell this agreement or any rights hereunder without the prior written consent of Yaga’s Entertainment, Inc. Yaga’s Entertainment, Inc. reserves the right to terminate the license granted by this agreement for good cause and, in said event, Applicant agrees to waive and forego all claims for damages and recourse of any kind. Applicant agrees to assume all risks arising out of or relating to it’s attendance or participation at said event and to protect, defend, indemnify and hold harmless Yaga’s Entertainment, Inc., the City of Galveston, Galveston Park Board of Trustees, GPM, Inc. and each of their agents, servants, contractors and employees from any and all liability, loss, damage or expense it may cause or sustain from any cause whatsoever, including fire, theft, personal injury or property loss. I further accept for myself and on behalf of my child full responsibility for any personal injury of any kind which may result from the use of the ski/snowboard equipment by my child, and it is my intention to HOLD HARMLESS Cascade Mountain Management Corporation, Cascade Mountain Land Holdings LLC and their owners, agents and employees for any injuries sustained to my child while using the above described equipment. I agree not to bring any action or lawsuit against the CASCADE MOUNTAIN RELEASEES for any personal injury caused by the NEGLIGENCE of any CASCADE MOUNTAIN RELEASEE. I understand that for a fee of $40.00 in addition to the normal entry fee, Cascade Mountain offers an optional Agreement that does not require me to sign a release of liability. In signing this Release of Liability, I acknowledge that I am aware of this option offered by Cascade Mount ain and hereby waive my right to purchase the same. I have carefully read this Release of Liability and Parental Permission Agreement and fully understand its contents. This document constitutes the final and entire agreement between Cascade Mountain Management Corporation, Cascade Mountain Land Holdings LLC and the undersigned. I am aware that by signing this document, I can not sellam WAIVING certain legal rights of myself and my child, give including the right to xxx Cascade Mountain Management Corporation or offer Cascade Mountain Land Holdings LLC for sale any pictures negligent acts or accounting omissions. I understand that a helmet designed for Recreational Snow Sports use will help reduce the risk of some types of injuries to the user. I recognize that serious injury or death can result from both low- and high-speed impacts, even when a helmet is worn. I understand that no helmet can protect the user against every foreseeable impact to the head, and that Recreational Snow Sports present unavoidable and inherent risks of injury which surpass the limits of protection offered by this helmet. I understand that this helmet does not protect against trauma to any other part of my slides/photos body, including my neck, face and spine, and that these limitations are unavoidable and inherent risks of any activity in which this helmet will not be returnedused. Applicant agrees In consideration of the rental of this helmet, I AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS Three Rivers Park District, its employees, owners, affiliates, agents, officers, directors (collectively “Providers”) from all liability for injury, death, property loss and damage which results from the equipment user’s participation in the Recreational Snow Sports for which the equipment is provided, or which is related in any way to observe and comply with all applicable laws, statutes, ordinances, rules and regulations. Applicant assumes all costs and liability arising from the use of patented, trademarked, copyrighted or service marked materials, this equipment, processes or creative rights. Applicant shall not assign or attempt to sell this agreement including all liability which results from the NEGLIGENCE, STRICT LIABILITY OR BREACH OF WARRANTY of Providers or any rights hereunder without other person or cause. In accordance with Minnesota law, nothing in this Release of Liability should be construed as releasing, discharging or waiving any claims I may have for conduct that constitutes greater than ordinary negligence on the prior written consent part of Yaga’s EntertainmentThree Rivers Park District. I agree not to transfer the helmet for use by any other person. (In the event the undersigned does transfer the helmet in violation of this agreement, Inc. Yaga’s Entertainment, Inc. reserves the right to terminate the license granted by this agreement for good cause and, in said event, Applicant he/she agrees to waive and forego all claims for indemnify Providers against any claim, demand, losses or damages and recourse of any kind. Applicant agrees to assume all risks arising out of the injury or relating property damage through use of the equipment. This agreement shall be binding and may be pled as a complete bar and defense against any claim, demand, action or causes of action by or on behalf of the undersigned or any user.) To the extent I am signing on behalf of a minor, I hereby release Three Rivers Park District from any and all liability for personal injury, death or property damage sustained by the minor which results in any way from negligence, conditions on or about the premises and facilities, the operations, actions or omissions of employees or agents of the area, or the minor’s participation in skiing, snowboarding or other activities at the area, accepting myself the full responsibility for any and all such damage or injury of any kind which may result. I AGREE THAT THE TERMS OF THIS AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for myself, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and causes legal representatives. It is my intention to fully assume all risks associated with this tour and to release Surf Gwada from any and all liability to the maximum extent permitted by law. Indemnification: I further agree to “indemnify” (meaning to defend and to pay or reimburse) Surf Gwada against any claim by any person, including minors, arising in whole or in part from an injury or other loss suffered or caused by me in connection with the expedition or my participation in the Adventure Activities. I understand this helmet does not protect against trauma to any other part of my body, including my neck, face and spine, and that these limitations are UNAVOIDABLE AND INHERENT RISKS of any activity in which this helmet will be used. Release of Liability. My application is a commitment I hereby agree that in consideration of Green Acres, Inc. allowing my participation in these activities and use of its facilities, under the terms set forth herein, I, the participant, for myself and on behalf of my child and/or legal xxxx, heirs, administrators, personal representatives or assigns, if any, do agree to show with all the created work being exhibited for salehold harmless, release and discharge Green Acres, Inc., its owners, agents, employees, officers, directors, representative, assigns, members, owners of premise, affiliated organizations, insurers, and I personally will be present at all times during each day others acting on its behalf (hereinafter collectively referred to as “ASSOCIATES”), of Galveston Island Shrimp Festival. I have read all of the Galveston Island Shrimp Festival application information and agree to abide by all the rules. I hereby release Galveston Island Shrimp Festival, Yaga’s Entertainment, Inc. the City of Galveston, festival organizers, volunteers, sponsors, property owners, and tenants from all claims, demands, actionscauses of action and legal liability, debtswhether the same be known or unknown, liabilitiesanticipated or unanticipated, due to Green Acres, Inc.’s and/or its ASSOCIATES’ ordinary negligence; I shall not bring any claims, demands, legal actions and causes of action action, against Green Acres, Inc. and/or its ASSOCIATES as stated above in this clause, for any economic and/or non-economic losses due to bodily injury, death, property damage sustained by me and/or my minor child and/or legal xxxx in relation to the premises and/or operations of every nature Green Acres, Inc. to include any or all activities, including, without limitation, riding, handling or otherwise being near a snow tube or tow rope owned by or in the care, custody and control of Green Acres, Inc., whether on or off the premises of Green Acres, Inc. I accept and understand the sport of snow-tubing involves many RISKS, DANGERS, and HAZARDS that may cause serious personal injury or death and injuries are a common and ordinary occurrence in this sport. I accept and understand that part of the thrill, excitement and risk of snow tubing are that Green Acres, Inc. has an open hill and not tubing lanes and that the snow tubes all end up in a common run-out area at various speeds and it is my responsibility to try to avoid hitting another snow tuber and it is my responsibility to try to avoid being hit by another snow tuber, but that notwithstanding these efforts by other snow tubers and myself, there is a risk of collisions. I agree it is my sole responsibility to view the tubing area before I participate and to not participate if the tubing area or adjacent areas or conditions are not to my satisfaction. I have been informed about and/or made aware of and herby certify that I, or tuber if tuber is a minor, meet(s) all admission requirements in terms of height, age, and any other requirement which may exist. I agree and understand that snow tubing is a purely voluntary, recreational activity and I acknowledge the undersigned might have against risks, dangers and hazards. I agree to allow the above by reason use of my image or likeness incidental in any photograph, or other transmission or reproduction of the event of any damagesform to which this agreement admits me. I agree to allow the use of my image or likeness, lossand/or the likeness or image of the Minor, theftincidental in any photograph, or injury other transmission or reproduction of the event of any form to person which this agreement admits me. I accept and understand Risks, Dangers and Hazards of snow tubing includes, but is not limited to the following: Variations in the steepness and configuration of the snow tubing hills and run out area; Variations in the surface upon which snow tubing is conducted, which can vary from wet, slushy conditions to hard packed icy conditions, bumps, bare spots and everything in between; Debris, fences, posts, trees, lift equipment and towers, light poles, signs, buildings, and walkways, padded and non-padded barriers, obstacles, snowmaking, grooming equipment to prevent or reduce injury; natural or man-made structures, damage to property, and equipment failure or bothtow rope owned by or in the care, resulting custody and control of Green Acres, Inc.; Little directional control with no braking system and changes in the speed at which snow tubes travel depending on surface conditions, the weight of snow tubers and the inter linking of snow tubes together to go down the snow tubing surface and run-out area; Collision in the run-out area and other locations of the snow tubing facility, with such collision happening between snow tube, between snow tube and another patron, between snow tube and snow tubing facility attendant, between snow tubing patrons who may or may not be in or on a snow tube at the time of collision and other sorts of collisions; collisions with fixed objects, obstacles, or structures located within or outside of the snow tubing facility; The use of the snow tubing lift or tow, including falling out of a tube, coasting backwards, becoming entangled with tow rope, guarantee or representation of the safety of the tube, equipment and other risks; In addition, I understand that a helmet designed for RECREATIONAL SNOW SPORTS use may help reduce the risk of some types of injuries to the user at slower speeds but that I recognize that serious injury or death can result from the entry both low and high energy impacts, even when a helmet is worn. This Agreement shall be governed by the signer on Galveston Island Shrimp Festival groundslaws of the State of Minnesota. Galveston Island Shrimp Festival reserves If any of its provisions are held to be invalid or unenforceable by a court of competent jurisdiction, such holding shall not invalidate any of the right to use artist's images to advertise and promote Galveston Island Shrimp Festivalother provisions of this Agreement, it being intended that the provisions of this Agreement are severable. I understand that my slides/photos will not be returned. Applicant agrees to observe DAMAGE TO PERSONAL PROPERTY and comply with all applicable laws, statutes, ordinances, rules and regulations. Applicant assumes all costs and liability arising from INJURIES OF ALL TYPES ARE A COMMON AND ORDINARY OCCURRENCE in the use sport of patented, trademarked, copyrighted or service marked materials, equipment, processes or creative rights. Applicant shall not assign or attempt to sell this agreement or any rights hereunder without the prior written consent of Yaga’s Entertainment, Inc. Yaga’s Entertainment, Inc. reserves the right to terminate the license granted by this agreement for good cause and, in said event, Applicant agrees to waive and forego all claims for damages and recourse of any kind. Applicant agrees to assume all risks arising out of or relating to it’s attendance or participation at said event and to protect, defend, indemnify and hold harmless Yaga’s Entertainment, Inc., the City of Galveston, Galveston Park Board of Trustees, GPM, Inc. and each of their agents, servants, contractors and employees from any and all liability, loss, damage or expense it may cause or sustain from any cause whatsoever, including fire, theft, personal injury or property losssnow tubing. I further acknowledge also know that the risk of SEVERE INJURY and DEATH exists when I am aware that participate in the sport of snow tubing.
