RELATIONSHIP TO THE NATIONAL EMPLOYMENT STANDARDS. Entitlements in accordance with the National Employment Standards (―NES‖) are provided for under the Fair Work Act 2009. Where this Agreement also has provisions regarding matters dealt with under the NES and the provisions in the NES set out in the Act are more favourable to an Employee in a particular respect than those provisions, then the NES will prevail in that respect and the provisions dealing with that matter in this Agreement will have no effect in respect of that Employee. The provisions in this Agreement otherwise apply.

RELATIONSHIP TO THE NATIONAL EMPLOYMENT STANDARDS. (NES) This agreement will be read and interpreted in conjunction with the National Employment Standards (NES). Where there is an inconsistency between this agreement and the NES and the NES provides greater benefit, the NES provision will apply to the extent of the inconsistency.
RELATIONSHIP TO THE NATIONAL EMPLOYMENT STANDARDS. The National Employment Standards (NES) are a set of minimum employment entitlements prescribed by the Fair Work Act 2009. These entitlements relate to, • Maximum weekly hours of work, • Requests for flexible working arrangements, • Offers and requests to convert from casual to permanent employmentParental leave and related entitlements, • Annual leave, • Personal/xxxxx’s leave, compassionate leave and family and domestic violence leave, • Community service leave, • Long service leave, • Public holidays, • Notice of termination and redundancy pay, • Provision of a Fair Work Information Statement and Casual Employment Information Statement. The NES will apply to employee/s subject to this Agreement. However, this Agreement may provide an employee with a more favourable outcome in a particular entitlement. In that case, the entitlement that favours the employee will apply. For the avoidance of doubt, no term in this agreement shall reduce an employee’s entitlements under the NES.

Certain provisions of this Agreement may supplement the NES but nothing in this Agreement will operate so as to provide a detrimental outcome for Employees as compared to an entitlement under the NES.

RELATIONSHIP TO THE NATIONAL EMPLOYMENT STANDARDS. ‌ Nothing in his Agreement is intended to reduce the employees’ entitlement under the National Employment Standards (NES). If any provision has the effect of reducing an employee’s entitlements under the NES, the NES will prevail to the extent of the inconsistency.

RELATIONSHIP TO THE NATIONAL EMPLOYMENT STANDARDS. The NES will apply at all times to the Employees covered by this Agreement. Where the NES provides a benefit not stated in this Agreement then the benefit of the NES will apply. Where the NES provides a higher benefit than that set out in this Agreement, the lower benefit contained in this Agreement shall be null and void and the benefit set out in the NES shall apply.

Where any provision of this Agreement is detrimental compared with the NES of the Act, then the NES will apply, to the extent of the detrimental provision, over the terms of the Agreement.
