RELATIONSHIP TO CURRENT. AWARDS This Agreement shall be read in conjunction with the terms of the MO Award and LGE Awards (as defined), provided that where there is any inconsistency between this Agreement and those Awards, this Agreement shall prevail to the extent of the inconsistency. CLAUSE 7 - OBJECTIVES OF AGREEMENT It is the objective of this Agreement to implement workplace practices so as to provide for more flexible working arrangements, which will improve the efficiency and productivity of the employer and the employees, enhance skills and job satisfaction and provide for security of employment for all employees, and to assist positively in ensuring that this Council becomes a more efficient enterprise. It is the view of all the parties that the objectives of this Agreement are to facilitate; • workplace productivity and cost effectiveness by embracing a “best practice” culture for Council, • flexible working arrangements and hours, • enhanced service to residents/customers of Whyalla Council, • implementation of employer’s Strategic Plan, • the development and maintenance of the most productive and harmonious working relationship obtainable, • provide security of employment for all employees, • continual development and participation in programs of continual improvement for Council, • continual implementation of performance indicators and benchmarking for work- teams within Council. It is also recognised that an important factor in achieving the above objectives is the development of a working environment where all parties are appropriately involved with the decision making process. Both the employer and the employees are committed to co- operating positively, to implement work practices that are flexible and meet the requirements of the employer. CLAUSE 8 - WORKPLACE CULTURE The means by which Whyalla Council becomes “the best” is critical if continual improvement is to be a permanent feature of the way the organisation goes about its business. This Agreement supersedes all previous certified Agreements CLAUSE 7 OBJECTIVES The Aims of this Agreement are to develop and support a flexible workforce and management structure committed to the continued improvement and success of the Wakefield Regional Council, and there upon develop and encourage an "Enterprise Culture". The parties believe that the desire to embrace measures aimed at achieving improved productivity will ultimately lead to the success of the Enterprise and therefore offer to Employees a sustainable level of job security. The aims and objectives of this Agreement will be achieved by addressing such matters as: • The removal of artificial demarcations and unreasonably restrictive working and management practices with a view to further and on-going harmonious industrial relations; • Improving flexibility in labour supply, without a reduction in current staff levels; • Reviewing and improving work arrangements; • Developing a high degree of participation, team work, trust and shared commitment to the goals and policies of the Wakefield Regional Council and the achievement of real and sustainable improvements in productivity; • Adoption of practices to improve standards of Occupational Health and Safety; • Looking at new ways of improving work practices and reduction of wastage and lost time; • Continuing development and adoption of initiatives designed to enhance Council's performance; • Introduction of measures to reduce absenteeism; • Continually looking at new ways to improve processes and customer satisfaction; • Affirmative action by all and commitment to Equal Employment Opportunity principles; • Ensuring Council's continued viability and stability, with all parties striving at all times to do all that is practical and reasonable to enhance, improve and sustain the image of the Wakefield Regional Council; • Implementing a training and skills improvement programme within the Wakefield Regional Council for all Employees. Such programme will enable Employees to increase their level of individual expertise and in turn improve the excellence of the Wakefield Regional Council through the provision of defined career paths and opportunities; and • Ensuring strict adherence to the Award, this Agreement and all statutory provisions. RELATIONSHIP TO CURRENT. AWARD This Agreement terminates and replaces all previous Certified Agreements and will be read in conjunction with the Local Government Employees (SA) Award, operative at the date of approval of this agreement and where inconsistent with the Award the terms of this Agreement shall prevail to the extent of the inconsistency. During the term of this Agreement the Authority undertakes to bargain collectively with the employees in respect of existing and new employees whose terms and conditions are covered by the Award.

  • Relationship to Plan This Award is subject to all of the terms, conditions and provisions of the Plan and administrative interpretations thereunder, if any, which have been adopted by the Committee thereunder and are in effect on the date hereof. Except as defined or otherwise specifically provided herein, capitalized terms shall have the same meanings ascribed to them under the Plan.

  • Relationship to the Plan This grant of Performance Units is subject to all of the terms, conditions and provisions of the Plan and administrative interpretations thereunder, if any, that have been adopted by the Board.   • Relationship to Award 2.1 This Agreement incorporates those terms of the National Electrical, Electronic and Communications Contracting Industry Award 1998 as at December 2005 (as amended) that are set out in Appendix K. A reference in this Agreement to the “Award” means the Award terms as set out in Appendix K.

  • Relationship with Lenders The obligations of each Lender hereunder are several, and no Lender shall be responsible for the obligations or Commitments of any other Lender. Amounts payable hereunder to each Lender shall be a separate and independent debt. It shall not be necessary for Agent or any other Lender to be joined as an additional party in any proceeding for such purposes. Nothing in this Agreement and no action of Agent, Lenders or any other Secured Party pursuant to the Loan Documents or otherwise shall be deemed to constitute Agent and any Secured Party to be a partnership, joint venture or similar arrangement, nor to constitute control of any Obligor.

  • Parties’ Relationship The parties to the Agreement are independent parties. BNY Mellon, in furnishing the Services, is acting as an independent contractor. BNY Mellon has the sole right and obligation to supervise, manage, contract, direct, procure, perform or cause to be performed, all work to be performed by BNY Mellon and its employees, agents, independent contractors and other representatives under the Agreement. At no time shall any such individuals represent himself or herself as an employee of a Fund or be considered an employee of a Fund. BNY Mellon is not a joint venturer with, nor an employee, agent or partner of the Funds and has no authority to represent or bind the Funds as to any matters.

  • Commercial Relationship The Employee expressly acknowledges that the Employee’s participation in the Program and the Company’s grant of the Award does not constitute an employment relationship between the Employee and the Company. The Employee has been granted the Award as a consequence of the commercial relationship between the Company and the Company’s Subsidiary in Mexico that employs the Employee, and the Company’s Subsidiary in Mexico is the Employee’s sole employer. Based on the foregoing: (a) the Employee expressly acknowledges that the Program and the benefits derived from participation in the Program do not establish any rights between the Employee and the Subsidiary in Mexico that employs the Employee; (b) the Program and the benefits derived from participation in the Program are not part of the employment conditions and/or benefits provided by the Subsidiary in Mexico that employs the Employee; and (c) any modifications or amendments of the Program or benefits granted thereunder by the Company, or a termination of the Program by the Company, shall not constitute a change or impairment of the terms and conditions of the Employee’s employment with the Subsidiary in Mexico.
