Redundancy entitlements. ‌ 21.1 Redundancy occurs where Delta Building Automation Pty Ltd has made a definite decision that it no longer wishes the job the employee has been doing done by anyone and that decision leads to the termination of employment of the employee. 21.2 Delta Building Automation Pty Ltd will pay redundancy contributions for each permanent employee, other than apprentices, into the Mechanical Electrical Redundancy Trust (MERT) at the rate of $65 per week for each employee or such higher amount as may be generally applicable. 21.3 Where an employee is terminated on account of redundancy, he or she will be paid a severance payment from the MERT fund in accordance with the provisions of the MERT fund in place at that time. By way of information, at the date of lodgement of this Agreement, the payments made by the MERT fund on termination on account of redundancy are equal to the value of the contributions paid into the fund by Delta Building Automation Pty Ltdin respect of that employee. PART D Hours of work‌ 22 Ordinary hours and rostered days off 22.1 The ordinary hours of work are 38 hours per week from the date of lodgement of this Agreement. 22.2 Ordinary hours may be worked between the hours of 6.00 am and 6.00 pm, Monday to Friday as determined by Delta Building Automation Pty Ltd. 22.3 The normal working hours arrangements are 8 ordinary hours of work each day which allows each employee to accumulate one Rostered Day Off (RDO) for each 19 days of work. 22.4 Where Delta Building Automation Pty Ltd and an individual employee agree, alternative arrangements may be introduced for the employee’s ordinary hours of work, subject to the employee not being required to work: (a) more than 38 ordinary hours in the week; (b) more than 10 ordinary hours on any day; and (c) ordinary hours outside the hours of 6.00 am to 6.00 pm, Monday to Friday without the payment of overtime rates. 22.5 Delta Building Automation Pty Ltd will determine the timing of RDOs for each employee, taking into account employee preferences and the availability of work.. 22.6 Where an employee has not used all accumulated RDOs before the commencement of the Christmas shutdown, the remaining RDOs will be taken during the shutdown.

Redundancy entitlements. ‌ 21.1 23.1 Redundancy occurs where Delta Building Automation Pty Ltd Shell Logistics has made a definite decision that it no longer wishes the job the employee has been doing done by anyone and that decision leads to the termination of employment of the employee, except where this is due to the ordinary and customary turnover of labour such as through resignation and retirement. 21.2 Delta Building Automation Pty Ltd will 23.2 For the purposes of this Section, week's pay redundancy contributions for each permanent means an employee, other than apprentices, into the Mechanical Electrical Redundancy Trust (MERT) at the ’s base rate of $65 per week for each employee or such higher amount as may be generally applicablepay and excludes: (a) overtime; (b) penalty rates; (c) disability allowances; (d) shift allowances; (e) special rates; (f) fares and travelling time allowances; (g) bonuses; and (h) any other ancillary payments of a like nature. 21.3 23.3 Where an employee is to be terminated on account due to redundancy, Shell Logistics must provide him or her with the period of notice specified in clauses 22.3 and 22.4 and may elect to pay the employee in lieu of all or part of the required period of notice. 23.4 An employee provided with notice of termination of employment due to redundancy may elect to finish employment within the notice period without penalty, but will not be paid in lieu for the period of notice not served. 23.5 Where an employee is transferred to lower paid duties by reason of redundancy, he : (a) the same period of notice must be given to the employee as if his or she her employment had been terminated; and (b) Shell Logistics may elect to pay the employee the difference between his or her former base rate of pay and the new base rate in lieu of all or part of the period of notice. 23.6 An employee whose employment is terminated by reason of redundancy will be paid a severance payment from the MERT fund in accordance relation to years of service with the provisions Company as follows: Employee’s continuous service Entitlement For the first completed year of the MERT fund in place service: 4 weeks For each year thereafter: 2 weeks Total redundancy payment is capped at that time.
