REDUCTION IN FORCE & RECALL. Section 1. It is the intent of the parties, through this article, to establish an objective procedure by which a reduction in force may be accomplished, should the need arise, and supersede the provisions of ORC 124.321 to 124.328, 124.37, OAC 123: 1-41-01 to 123: 1-41-22, and all local rules and regulations of the Alliance Municipal Civil Service Commission governing work force reductions.

REDUCTION IN FORCE & RECALL. A. Reductions in force (RIF) and recall of TEACHERS that occur during the term of this Agreement will be governed by the Illinois School Code provisions in effect at the time of the RIFs and recalls (105 ILCS 5/24-12).

REDUCTION IN FORCE & RECALL. A teacher whose name appears on the RIF List shall be offered reemployment when a position becomes available for which he/she is certified at the time the recall is made by the Superintendent, or his designee. Teachers shall be returned to active employment in reverse order of layoff to fill vacancies for which they are certified.

REDUCTION IN FORCE & RECALL. (a) When a reduction-in-force is to be made in a job classification, the employee having the least amount of classification seniority within the affected job classification shall be laid off first. However, if the displaced employee has classification seniority in any other classification with WEMS and meets the job qualifications, then such employee may bump back to those classifications provided that they have more classification seniority than other employees in that other classification.
REDUCTION IN FORCE & RECALL. 6.1 Seniority shall be defined as the total length of service within the District as per the first day of paid status in a regular position. Any unpaid leave which exceeds thirty (30) working days will not be counted toward seniority. Employees who are laid off as the result of a reduction in positions and who are subsequently reinstated shall retain seniority except for the period of lay off. If two (2) or more employees subject to lay off have equal seniority, the determination as to who shall be laid off will be made on the basis of greater total length of service within the District as per the first day of paid status in a regular position or, if it is equal, then the determination shall be made by lot.
REDUCTION IN FORCE & RECALL. When by reason of decreased enrollment of pupils, elimination of programs, return to duty of regular teachers after leaves of absence, or by reason of suspension of schools or territorial changes affecting the District, it becomes necessary to reduce the number of Employees, the Board may make a reasonable reduction. For purpose of Reduction in Force/Recall, there shall be the following classification groups:

If at any time subsequent to the reduction in force of a certified employee, a position becomes available for which the employee is certified and qualified to teach, the employee will be recalled in reverse order of layoff. Recall rights shall be in accordance with the School Code of Illinois.
