Common use of Redefined Terms Clause in Contracts

Redefined Terms. The term “Transaction Documents,” as defined in the SPA, shall be deemed to refer to and include the New Debentures, this Amendment and all other documents or instruments executed in connection with this Amendment and the issuance of the New Debentures. The term “Securities,” as defined in the SPA, shall be deemed to refer to and include the New Debentures and the Shares, and any additional Common Stock or other securities of the Company at any time issued to Buyer in connection with the SPA, this Amendment or any other Transaction Documents. The term “SEC Documents,” as defined in the SPA, shall be deemed to refer to and include all filings made by the Company with the SEC between the date of the SPA and the date of this First Amendment.
