Recyclable Materials to be Collected. 5.4.1 To the extent that the San Xxxx Obispo County Source Reduction, Recycling Element (SRRE), a two volume set currently existing and as hereafter amended or updated, has been implemented by County, Franchisee agrees to comply with its provisions. Franchisee must also comply with the California Integrated Waste Management Act. The SRRE selects recycling programs as a means of diverting waste. Green waste and other recyclable materials collected under this Agreement shall, absent extenuating circumstances as determined by County, be converted into a functional and marketable product in order that the materials may be diverted from landfill disposal in compliance with County's SRRE and the Integrated Waste Management Act. Franchisee’s collection and processing methods and the facility used shall, at all times, absent extenuating circumstances as determined by County, comply with the Integrated Waste Management Act and the SRRE, to the extent the SRRE has been implemented by County. Franchisee shall give notice to County at least thirty (30) days prior to any proposed change in processing. County shall at all times have the right to determine the suitability and cost-effectiveness of the diversion process.
Recyclable Materials to be Collected. The CONTRACTOR shall collect all Recyclable Materials that are accepted by the Designated Recycling Facility and that are placed in a Recycling Bin or Recycling Cart. Old corrugated cardboard which has been broken down that is placed beside a Recycling Bin or Recycling Cart, and newspapers that are contained in paper bags and placed beside the Recycling Bin or Recycling Cart shall be collected by the CONTRACTOR. Old corrugated cardboard and newspaper that have been properly set out and have become wet due to local weather conditions shall be collected by the CONTRACTOR. At such time as the CITY desires to add additional materials to the Recyclable Materials collected, the CITY shall submit to the CONTRACTOR an expansion proposal, and the CONTRACTOR receiving such proposal shall evaluate and consider the same in good faith. If the CONTRACTOR and the CITY fail to reach an agreement with respect to the terms and conditions for expansion of the services within sixty (60) calendar days of submission of expansion proposal, the CONTRACTOR shall continue to perform all services as provided by Agreement for the remaining term thereof. Recyclable Materials to be Collected. The following Recyclable Materials shall be collected in the residential recycling collection program: Newspaper, mixed paper (phone books, magazines, computer paper, junk mail, and paper bags), cardboard, glass bottles and jars, aluminum cans, plastic containers, tin/steel cans and any additional materials that can be recovered at the Designated Recycling Facility used by Contractor. Additional materials may be added to the program subject to available markets, upon terms and conditions mutually agreed upon by both Parties.

  • REMANUFACTURED, RECYCLED, RECYCLABLE OR RECOVERED MATERIALS Upon the conditions specified in the Bid Specifications and in accordance with the laws of the State of New York, Contractors are encouraged to use recycled, recyclable or recovered materials in the manufacture of Products and packaging to the maximum extent practicable without jeopardizing the performance or intended end use of the Product or packaging unless such use is precluded due to health, welfare, safety requirements or in the Bid Specifications. Contractors are further encouraged to offer remanufactured Products to the maximum extent practicable without jeopardizing the performance or intended end use of the Product and unless such use is precluded due to health, welfare, safety requirements or by the Bid Specifications. Where such use is not practical, suitable, or permitted by the Bid Specifications, Contractor shall deliver new materials in accordance with the “Warranties" set forth below. Items with recycled, recyclable, recovered, refurbished or remanufactured content must be identified in the Bid or Bidder will be deemed to be offering new Product.

  • Packaging Materials and Containers for Retail Sale Packaging materials and containers in which a good is packaged for retail sale shall, if classified with the good, be disregarded in determining whether all the non-originating materials used in the production of the good undergo the applicable change in tariff classification set out in Annex 4, and, if the good is subject to a regional value-content requirement, the value of such packaging materials and containers shall be taken into account as originating or non-originating materials, as the case may be, in calculating the regional value content of the good.

  • Recycled Products The Provider shall procure any recycled products or materials, which are the subject of or are required to carry out this Contract, in accordance with the provisions of sections 403.7065, F.S.

  • Selection of Subcontractors, Procurement of Materials and Leasing of Equipment The contractor shall not discriminate on the grounds of race, color, religion, sex, national origin, age or disability in the selection and retention of subcontractors, including procurement of materials and leases of equipment.   • Materials and Improvements Title to materials, improvements, and other property required of PURCHASER by this contract shall vest in and become the property of STATE at the time such are furnished by PURCHASER and accepted by STATE. Only materials, improvements, and property free and clear of liens, claims, and encumbrances shall be furnished by PURCHASER. All existing improvements located on State land, and any improvements placed on State land by PURCHASER which become the property of STATE, shall be safeguarded by PURCHASER. If such improvements are injured, damaged, or removed from the areas of operations by PURCHASER or by contractors of PURCHASER, such improvements shall be repaired (or replaced, in the event of removal,) as soon as possible by PURCHASER, without cost to STATE.

  • Materials and Equipment ‌ Material means property that may be consumed or expended during performance, component parts of a higher assembly, or items that lose their individual identity through incorporation into an end item. Equipment means a tangible item that is functionally complete for its intended purpose, durable, nonexpendable, and needed for performance. Materials and Equipment shall be priced in accordance with the terms of the task order award, contract type, and applicable FAR and agency-specific regulatory supplements. Unless otherwise directed by task order terms and conditions, the Contractor may apply indirect costs to materials and equipment consistent with the Contractor’s usual accounting practices.

  • Stored Materials The Department shall not be required to pay for materials stored at the site or stored at other locations absent prior written authorization to do so, which authorization may be withheld at the Department's sole discretion. If the Department expressly agrees to pay for materials stored at the site but not yet incorporated into the Work, the Application for Payment may also include a request for payment of the cost of such materials, if the materials have been delivered to the site, and suitably stored. Such requests shall be documented by appropriate invoices and bills of sale. Payment for stored materials shall be conditioned also on the Design-Builder’s representation that it has inspected the material and found it to be free from defect and otherwise in conformity with this Agreement, and on satisfactory evidence that the materials are insured under the builder’s risk policy. Further, if the Design-Builder requests the Department to allow payments for storage of materials offsite, the Design-Builder shall be required, inter alia, to agree to execution of proper documentation to afford the Department a secured interest in the materials upon payment.

  • GARBAGE DISPOSAL, RECYCLING, AND BIODEGRADABLE MATERIALS A. Concessionaire shall be responsible for maintaining the cleanliness of the Concession Premises. Concessionaire shall ensure placement of all garbage and trash generated by the Concession Operation in designated containers and that said containers are emptied daily, or as more frequently required by Department, at a location within the Area designated by Department. Disposal costs from this latter location shall be borne by Department. Concessionaire shall provide such additional trash containers as may be required to keep the immediate Concession Premises clean at all times. The type of trash containers provided by Concessionaire shall be approved by Department prior to use.
