The number of search and rescues missions has fluctuated over the years. On average, 12 SARs occur yearly that consists mostly of all rescues and occasionally a fatality. Injuries included fractures, sprains, dislocations, frostbite, cerebral edema, punctures, lacerations, hematomas, etc. The Mt. Shasta Wilderness is a mountaineering destination wilderness area. The unparalleled ease of access attracts visitors with a wide variety of skill levels and experience with climbing and mountaineering techniques in a high elevation environment with significant objective hazards. Climbing conditions can range from benign to severe on a day-to-day basis. With few exceptions, there is quality cell phone coverage on all sides of the mountain. Under fair conditions, Mt. Shasta is an accessible goal for many climbers. When conditions are poor, climbing Mt. Shasta is a formidable mountaineering challenge with a high degree of risk. Pursuant to 16 USC 575, the Secretary of Agriculture is authorized to “incur such expenses as may be necessary in searching for persons lost within the National Forests or to provide transportation to persons seriously ill, injured, or who die within the National Forests, to the nearest place where the sick or injured person(s) may be transferred to interested parties or local authorities.” The primary responsibility, however, is that of the County Sheriff and although the Forest Service may be the first on the scene, the search and rescue responsibility will be under the umbrella of County authority. Recreational Use. Certain terms and conditions contained in Article X of the Battle North Agreement provide for allowed public recreational uses of the Bolts Lake reservoir including: (i) non- motorized boating, (ii) fishing from shores, boats, or float tubes (i.e. belly boats), (iii) paddle boarding, (iv) picnicking, (v) hiking around lake, and (vi) other future uses approved by the District and Authority. The District and Authority confirm that Article X of the Battle North Agreement is strictly a type of use limitation and that the granting of authority to use or operate the Bolts Lake reservoir remains at the discretion of the District and Authority, as further acknowledged in Section 10.1(k) of the Battle North Agreement. The District and Authority hereby authorize Minturn the right to provide recreational services and facilities to the general public as follows:
(a) Any recreational use of Bolts Lake shall be secondary and subordinate to the primary use of Bolts Lake by the District and the Authority for the existing and future decreed uses.
(b) Any recreational use shall be limited to: (i) non-motorized boating, (ii) fishing from shores, boats, or float tubes (i.e. belly boats),
(iii) paddle boarding, (iv) picnicking, (v) hiking around lake, and (vi) other future uses approved by the District and Authority. Minturn shall be allowed to stock Bolts Lake with fish subject to the provisions of paragraph 11 of this Covenant. Except for the above permitted uses, no other recreational uses shall be allowed on Bolts Lake. Moreover, no recreation use of Bolts Lake by a commercial operator shall be permitted.
Recreational Use. Personal leave days cannot be used for recreational purposes.
Recreational Use. 1. Unpaved paths or foot trails may be established and maintained on the Protected Property for recreational uses and shall be established, maintained and used in a manner that does not result in significant erosion or have an adverse impact on the Conservation Values and Conservation Purposes of the Protected Property. No other trails shall be established and maintained on the Protected Property except as specifically allowed for in the approved Master Plan.
2. Motorized vehicles may be operated with the consent of the Buyer on the Protected Property only in the following manner:
a. On trails designated for their use.
b. For city maintenance, emergency, Americans with Disabilities Act compliance and management purposes.
c. In conjunction with the Master Plan or Management Plan operations or for habitat restoration or enhancement as prescribed in the approved Management Plan.
d. In a manner that does not result in significant erosion or have an adverse impact on the Conservation Values and Purposes of the Protected Property.
3. The Protected Property may be used for hiking, cross-country skiing, picnicking, nature observation and interpretation or study, and other similar low impact recreational and educational programs or activities.
4. The Protected Property may not be used for more than minimal commercial recreation purposes. It is the intent of the parties to prevent the Protected Property from becoming the site of a commercial recreational enterprise, such as a commercial campground, a golf course, a commercial ski area, an exclusive hunting grounds or club, a commercial site for a snowmobiling, ATV motocross or other race track, a dressage field, or other similar intensive or predominantly commercial use, but this restriction shall not be construed to mean the occasional or casual use of or access to the Protected Property by individuals or groups who pay a fee to a guides, educators, outfitters or supervisors of outdoor recreation activities or who pay a fee for low-impact outdoor recreational uses.
5. Low-impact structures such as tents, trail barriers, benches, and informational kiosks may be placed on the Protected Property.
6. Structures and improvements to support the recreation uses permitted in this Conservation Easement shall be permitted as specifically described in the approved Concept Plan and Master Plan. Structures and improvements shall be placed and constructed in accordance with the following:
