Recovery Right Sample Clauses
Recovery Right. The Insured shall not be entitled to any indemnity under this Contract for any loss if the Insured has done or does anything to prejudice the Insured’s right of recovery against any person for such loss.
Recovery Right. If an audit conducted under clause 18.2 establishes that there has been any overpayment or underpayment under this agreement, the amount of that overpayment or underpayment is a debt due by the Practice to WorkSafe Victoria or by WorkSafe Victoria to the Practice (as the case may be), which must be paid promptly after being established as a result of the audit. Recovery Right. PCP acknowledges and agrees that VISTA shall have the right to recover any and all amounts due VISTA by PCP under this Agreement, as determined by VISTA in VISTA's sole discretion and in accordance with applicable laws and regulations.
Recovery Right. If College applies any emergency preservation measure to or disposes of the Exhibit under the preceding paragraph, then:
1. College has a right to perfect a lien on the Exhibit and on any proceed from any disposition of that lien for any related cost that the College incurs;
2. College is not liable for injury to or loss of the Exhibit if:
a. College had a reasonable belief at the time the action was taken that:
i. the action was necessary to protect the Exhibit or other property in College’s custody; or
ii. the Exhibit constituted a hazard to the health and safety of the public or College’s staff or agents; or
iii. while applying the emergency preservation measure, College exercised reasonable care in choosing and applying that emergency preservation measure.
3. College must use any insurance proceed to the extent available to cover ▇▇▇▇▇▇’s loss.
Recovery Right. Where, as a result of any audit conducted under clause 15.3, the TAC or WorkSafe determines that any of the Funding has been used otherwise than in accordance with this agreement, including clause 6, the amount of that Funding is a debt due to the TAC or WorkSafe (as applicable) which Monash must reimburse to the TAC or WorkSafe (as applicable) within 10 Business Days of receiving notice from the Institute requiring reimbursement.
