Recoverable Subcontractor Costs. When the Work is performed by a Subcontractor, the Contractor may be paid the actual and necessary costs of such subcontracted Work as outlined above in Articles 44.7.1.1 through 44.7.1.6, and an additional overhead of five (5%) percent of the costs outlined in Articles 44.7.1.1 through 44.7.1.3.

Recoverable Subcontractor Costs. When the Construction Work is performed by a Contractor, the prime Contractor’s Delay Costs shall include the actual and reasonable cost of such subcontracted Construction Work as outlined above in 3(a)(1) through 3(a)(7) and an additional overhead of 5% of the Contractor costs outlined in items 3(a)(1) through 3(a)(3) above. However, there will not be any such markup for Contractors below the first tier.
