Recount Clause Samples
The Recount clause establishes the process for verifying and correcting vote counts or tallies in the event of a dispute or close results. Typically, it outlines the circumstances under which a recount can be requested, the procedures to be followed, and the parties responsible for conducting the recount, such as an independent auditor or election official. This clause ensures accuracy and transparency in the outcome of a vote, addressing concerns about errors or irregularities and providing a clear mechanism for resolving disputes over results.
Recount. 1. The LPS shall advise the Contracting Officer if a recount is required by law or requested and the Contracting Officer and the LPS shall discuss how such recount is to be conducted. The LPS shall reimburse the Contracting Officer for the cost of such count which in not included in the original estimate/invoice.
Recount. The Jurisdiction shall be responsible for costs of a recount concerning any Jurisdiction ballot issue or question, pursuant to C.R.S. § 1-10.5-101 and § 1-11-215 except for costs collected from an “interested party” pursuant to C.R.S. § 1-10.5-106 which shall be collected by the entity conducting the recount.

Recount. 1. If required by law, the Contracting Officer shall perform a partial manual count of electronic voting system ballots in accordance with section 127.201 of the Texas Election Code. A recount may also be requested in accordance with Chapter 212 of the Texas Election Code.

Dominion will be available to assist the ROV’s staff in operation of Democracy Suite during the conduct of any recounts. Dominion will provide examples of recount procedures that the ROV can review when creating procedures for recounts. Contractor will refresh EMS server hardware and related third party software one time at County's request, at a time of County’s choosing during the Agreement Term, at no additional cost to the County. Recount. A Recount cost would be billed at the applicable lease rate to the authority responsible for the canvassing of that election. The guidelines for a Recount can be found in the Texas Election Code, Title 13, Chapters 211 through 216.
