RECORDS – AVAILABILITY/ACCESS. Subject to the requirements of Minnesota Statutes section 16C.05, subd. 5, COUNTY, the State Auditor, or any of their authorized representatives, at any time during normal business hours, and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt, and transcribe any books, documents, papers, records, etc., which are pertinent to the accounting practices and procedures of CONTRACTOR and involve transactions relating to this Agreement. CONTRACTOR shall maintain these materials and allow access during the period of this Agreement and for six (6) years after its expiration, cancellation or termination.
RECORDS – AVAILABILITY/ACCESS. To the extent applicable under federal and state law, subject to the requirements of Minnesota Statutes Section 16C.05, Subd. 5 (as may be amended), the USER agrees that the COUNTY, the State Auditor, the Legislative Auditor or any of their duly authorized representatives at any time during normal business hours, and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt, and transcribe any books, documents, papers, records, etc., which are pertinent to the accounting practices and procedures of the USER and involve transactions relating to this Agreement. Such materials shall be maintained and such access and rights shall be in force and effect during the period of the contract and for six (6) years after its termination or cancellation.

SUBSCRIBER shall maintain these materials and allow access during the period of the Agreement and for six (6) years after its termination or cancellation.

Such materials shall be maintained and such access and rights shall be in force and effect during the period of the contract and for six (6) years after its termination or cancellation.

Subject to applicable law, including but not limited to the requirements of Minnesota Statutes section 16C.05, subd. 5, and Medicare requirements under section 952 of the Omnibus Reconciliation Act of 1980 (PL 96-499) as well as any final regulations relating thereto as may be promulgated by the Secretary of HHS (the “Secretary”), CONTRACTOR agrees that COUNTY, the State Auditor, the Legislative Auditor, the Centers for Medicare & Medicaid Services (CMS), DHS, HHS, the Comptroller General, and other relevant federal and state authorities, or any of their authorized representatives, at any time during normal business hours, and as often as they may reasonably deem necessary, shall have access to the premises, physical facilities and equipment of CONTRACTOR and the right to examine, audit, excerpt, evaluate and transcribe any books, records and documents, financial records, claims history records, policies and procedures, provider review history, complaints, payment methodology, provider contracts and other related agreements, and patient care documentation, which are pertinent to services performed under this Agreement, including but not limited to medical, claims, care management, service authorization records and documentation of the quality, appropriateness, and timeliness of such services, or are pertinent to the accounting practices and procedures of CONTRACTOR that involve transactions relating to this Agreement, including, but not limited to, records of related entities, contractors, subcontractors, or transferees of CONTRACTOR that pertain to any aspect of services performed, reconciliation of benefit liabilities, and determination of amounts payable under the Agreement. Such materials shall be maintained and such access and rights shall be in force and effect during the period of the Agreement and for ten (10) years after its termination or cancellation or completion of audit, whichever is later, or for such longer period as may be necessary as required by DHS, CMS or any other applicable federal or state authority if 1) DHS or CMS determines there is a special need to retain a particular record or records for a longer period of time and DHS or CMS has notified HENNEPIN HEALTH at least thirty (30) days prior to the normal record disposition date; 2) there has been a termination, dispute, fraud, or similar default by CONTRACTOR, in which case HENNEPIN HEALTH may extend the record(s) retention period to ten (10) years from the date of any resultin...
