Common use of Recordation of Agreement Clause in Contracts

Recordation of Agreement. To the extent permitted by applicable law, this Agreement, or a memorandum thereof if permitted under applicable law, is subject to recordation in all appropriate public offices for real property records in all of the counties or other comparable jurisdictions in which any or all of the properties subject to the Mortgages are situated, and in any other appropriate public recording office or elsewhere, such recordation to be effected by the Depositor on direction and at the expense of Holders of not less than 66-2/3% of the Note Principal Balance of the Notes and of the Holder of the Ownership Certificate requesting such recordation, but only when accompanied by an Opinion of Counsel to the effect that such recordation materially and beneficially affects the interests of the Noteholders, or is necessary for the administration or servicing of the Mortgage Loans.

Recordation of Agreement. To the extent permitted by applicable law, this Agreement, or a memorandum thereof if permitted under applicable law, is subject to recordation in all appropriate public offices for real property records in all of the counties or other comparable jurisdictions in which any or all of the properties subject to the Mortgages Properties are situated, and in any other appropriate public recording office or elsewhere, such recordation to be effected by the Depositor Servicer at the Owners' expense on direction and at the expense of Holders of not less than 66-2/3% of the Note Principal Balance Owners of the majority of the Percentage Interest of the Notes and of or the Holder of the Ownership Certificate requesting such recordationNote Insurer, but only when accompanied by an Opinion opinion of Counsel counsel to the effect that such recordation materially and beneficially affects the interests of the Noteholders, Owners or is necessary for the administration or servicing of the Mortgage Home Equity Loans.

Recordation of Agreement. To the extent permitted by applicable law, this Agreement, or a memorandum thereof if permitted under applicable law, is subject to recordation in all appropriate public offices for real property records in all of the counties or other comparable jurisdictions in which any or all of the properties subject to the Mortgages are situated, and in any other appropriate public recording office or elsewhere, such recordation to be effected by the Depositor on direction and at the expense of Holders of not less than 66-2/3% of the Note Principal Balance Amount of the Notes and of the Holder of the Ownership Trust Certificate and at the expense of those requesting such recordation, but only when accompanied by an Opinion of Counsel to the effect that such recordation materially and beneficially affects the interests of the NoteholdersSecurityholders, or is necessary for the administration or servicing of the Mortgage Loans.

Recordation of Agreement. Recordation of Agreement. To the extent permitted by applicable law, this Agreement, or a memorandum thereof if permitted under applicable law, is subject to recordation in all appropriate public offices for real property records in all of the counties or other comparable jurisdictions in which any or all of the properties subject to the Mortgages Resorts are situated, and in any other appropriate public recording office or elsewhere, such recordation to be effected by the Depositor Servicer at the Owners' expense on direction and at the expense of Holders of not less than 66-2/3% of the Note Principal Balance of the Notes and of the Holder of the Ownership Certificate requesting such recordationMajority Noteholders, but only when accompanied by an Opinion opinion of Counsel counsel to the effect that such recordation materially and beneficially affects the interests of the Noteholders, Owners or is necessary for the administration or servicing of the Mortgage LoansReceivables.

Recordation of Agreement. To the extent permitted by applicable law, this Agreement, or a memorandum thereof if permitted under applicable law, is subject to recordation in all appropriate public offices for real property records in all of the counties or other comparable jurisdictions in which any or all of the properties subject to the Mortgages are situated, and in any other appropriate public recording office or elsewhere, such recordation to be effected by the Depositor on direction and at the expense of Holders of not less than 66-2/3% of the Note Principal Balance Amount of the Notes Securities and of the Holder of the Ownership Certificate requesting such recordation, but only when accompanied by an Opinion of Counsel to the effect that such recordation materially and beneficially affects the interests of the NoteholdersSecurityholders, or is necessary for the administration or servicing of the Mortgage Loans.

Recordation of Agreement. To the extent permitted by applicable law, this Agreement, or a memorandum thereof if permitted under applicable law, is subject to recordation in all appropriate public offices for real property records in all of the counties or other comparable jurisdictions in which any or all of the properties subject to the Mortgages are situated, and in any other appropriate public recording office or elsewhere, such recordation to be effected by the Depositor Servicer at the Securityholders' or the Note Insurer's expense on direction and at the expense of Holders of not less than 66-2/3% of Majority Securityholders or the Note Principal Balance of the Notes and of the Holder of the Ownership Certificate Insurer's requesting such recordation, but only when accompanied by an Opinion of Counsel to the effect that such recordation materially and beneficially affects the interests of the NoteholdersSecurityholders or the Note Insurer, as applicable, or is necessary for the administration or servicing of the Mortgage Home Loans.

Recordation of Agreement. To the extent permitted by applicable law, this Agreement, or a memorandum thereof if permitted under applicable law, is subject to recordation in all appropriate public offices for real property records in all of the counties or other comparable jurisdictions in which any or all of the properties subject to the Mortgages are situated, and in any other appropriate public recording office or elsewhere, such recordation to be effected by the Depositor Servicer at the related Certificateholders' expense on direction and at the expense of Holders of not less than 66-2/3% of the Note Principal Balance of related Majority Certificateholders or the Notes and of the Holder of the Ownership Certificate Insurer requesting such recordation, but only when accompanied by an Opinion of Counsel to the effect that such recordation materially and beneficially affects the interests of the Noteholders, related Certificateholders or the Certificate Insurer or is necessary for the administration or servicing of the related Mortgage Loans.

Recordation of Agreement. Recordation of Agreement.
