Common use of Recordation and Filing Clause in Contracts

Recordation and Filing. The Memorandum of Facility Lease and Memorandum of Site Lease have been duly recorded and are in a form sufficient to provide notice of the interests purported to be created by the Facility Lease and Site Lease, respectively. Upon the recordation of the Memorandum of Site Lease in the county in which the Site is located, the Memorandum of Site Lease will have been recorded or filed in such place in which recording or filing is required to provide notice, under Applicable Law, of the interests created by the Site Lease and to protect the validity and effectiveness thereof, and all Taxes, fees and other public charges payable in connection with the filing and recordation of the Memorandum of Site Lease have been paid.
