Recognition of Bargaining Unit. 2.1 The Employer recognizes the Union as the sole and exclusive bargaining agent and representative for all persons employed or engaged within the Union’s territorial jurisdiction in the classifications listed in ARTICLE 12 as well as all persons engaged to perform substantially the same work as those classifications listed in ARTICLE 12, all of whom are called “Employees”. Any dispute concerning whether any person is included in the bargaining unit shall be resolved under the Grievance and Arbitration Procedure. Nothing in this paragraph or in ARTICLE 3.5 below is intended, nor shall it be construed, either to enlarge or diminish the work customarily and usually performed by Employees in the bargaining unit nor is it intended to diminish or enlarge that work customarily and usually performed by persons not in the bargaining unit.

For clarity, the term paramedical employee includes: such classifications as occupational therapists, speech therapists, speech pathologists, physiotherapists, therapeutic and administrative dietitians, registered and non-registered pathological technologists, radiological technologists (radiography), radiological technologists (nuclear medicine), registered and non-registered respiratory technologists, registered and non-registered EEG, ECG and opthamology technicians, registered and non-registered ultrasound technologists, glaucoma technicians, ear-nose and throat technicians, cardiovascular technicians, electroencephalographists, electrical shock therapists, laboratory technicians, laboratory assistants, electronic technicians, psychometrists, pharmacists, pharmacy technicians, psychologists, remedial gymnasts, medical records librarians, social workers, child careworkers, nutritionists, dental health educators and bio-medial technicians. The Board notes the agreement of the parties that “paramedical personnel” also includes psychometry technicians, chiropodists, parental instructors, audiologists, research assistants, dental assistants, perfusionists, clinical instructors, medical photographers, technical assistants, entrostomol therapists, respiratory therapists, hyperbaric controllers, hyperbaric attendants and heath records administrators. It is agreed that the above clarification will not result in displacing any employees presently considered by the parties to be in the bargaining unit.

Recognition of Bargaining Unit. This Agreement is entered into by the employee organization of the bargaining unit, affiliated as Local 0023 of The International Association of Sheet Metal, Air, Rail and Transportation Workers (“SMART”), formerly known as United Transportation Union, hereinafter referred to as “the Union”, and the Santa Xxxx Metropolitan Transit District, hereinafter referred to as “METRO”. Pursuant to METRO rules, regulations, ordinances and resolutions, METRO has certified the Union as the exclusive recognized employee organization of the bargaining unit, consisting of all employees as identified in Article 9. METRO further recognizes the Union, pursuant to California State Utilities Code Section 98167, as the exclusive representative for the purpose of bargaining collectively with respect to wages, hours, working conditions and other conditions of employment for all Bus Operators of METRO within the bargaining unit defined in this Agreement. If the recognized employee organization elects at any time during the life of this Agreement to change its affiliation, the organization may exercise that option in accordance with applicable state law and METRO rules, regulations, ordinances and resolutions. Upon receipt of certified affiliation election results, the Board of Directors will meet and shall grant, within thirty (30) days, recognition to the new employee organization.
