When an Agency initiates an upward reclassification of a position, the affected employee shall be notified in writing.\nSection 3. If a reclassification request which is approved by the Agency does not receive Department of Administrative Services or legislative approval, the duties of the position will be restructured to conform to the prior classification. The employee shall be paid the rate of pay of the higher level classification from the first of the month following the month in which the reclassification request was received by the Agency to the date the duties were removed.\nSection 4. The Agency Office of Human Resources shall notify an incumbent employee and the Union in writing sixty (60) days in advance of a downward reclassification of a position and the specific reasons for the action. When an employee is reclassified downward, the employee's rate of pay shall be that of the last salary rate earned in the salary range of the previous classification. If an employee is reclassified to a position with a lower pay range, the employee\u2019s pay rate may remain the same if it is within the pay range of the lower classification. The County will move the employee to the lower pay range at the existing rate of pay. If this move places the employee between steps, the County will place the employee on the next higher step. If the employee\u2019s current pay rate is not within the new lower range, the reduction in wages shall not occur until one (1) year after the effective date of the reclassification.\nSection 5. In the event that an employee\u2019s position is reclassified upward, the employee will not be required to serve a trial service period if they have been performing the higher-level duties for at least six (6) months. If the employee has not been performing the higher-level duties for at least six (6) months, they will be required to serve a six (6)-month trial service period. Employees who fail their trial service periods, will be laid off and treated as laid-off employees subject to recall to the former classification for which they attained regular status or priority placement as laid-off employees.\nSection 6.
